HB 916 LC 11 8664 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 3 of Chapter 10 of Title 16 of the Official 1- 2 Code of Georgia Annotated, relating to escape and other 1- 3 offenses related to confinement, so as to provide for the 1- 4 offense of riot in a penal institution; to provide for a 1- 5 penalty; to repeal conflicting laws; and for other purposes. 1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 7 Article 3 of Chapter 10 of Title 16 of the Official Code of 1- 8 Georgia Annotated, relating to escape and other offenses 1- 9 related to confinement, is amended by adding at the end 1-10 thereof a new Code Section 16-10-56 to read as follows: 1-11 "16-10-56. (Index) 1-12 (a) Any person legally confined to any penal institution 1-13 of this state or of any political subdivision of this 1-14 state who commits an unlawful act of violence or any other 1-15 act in a violent or tumultuous manner commits the offense 1-16 of riot in a penal institution. 1-17 (b) Any person who violates subsection (a) of this Code 1-18 section is guilty of a felony and, upon conviction 1-19 thereof, shall be punished by imprisonment of not less 1-20 than one nor more than 20 years." SECTION 2. 1-21 All laws and parts of laws in conflict with this Act are 1-22 repealed. -1- (Index)
