HB 949 LC 24 0171 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act creating the Cobb Judicial Circuit, approved 1- 2 February 19, 1951 (Ga. L. 1951, p. 184), as amended, 1- 3 particularly by an Act approved April 5, 1994 (Ga. L. 1994, 1- 4 p. 4622), so as to change the provisions relative to the 1- 5 compensation of the chief investigator, the investigators, 1- 6 the chief assistant district attorney, and the assistant 1- 7 district attorneys; to provide for an effective date; to 1- 8 repeal conflicting laws; and for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 An Act creating the Cobb Judicial Circuit, approved February 1-11 19, 1951 (Ga. L. 1951, p. 184), as amended, particularly by 1-12 an Act approved April 5, 1994 (Ga. L. 1994, p. 4622), is 1-13 amended by striking Section 4A in its entirety and inserting 1-14 in lieu thereof a new Section 4A to read as follows: "SECTION 4A. 1-15 Said district attorney is authorized to appoint eight 1-16 investigators for the Cobb Judicial Circuit to serve at 1-17 the pleasure of said district attorney and to perform 1-18 generally such duties as may be assigned by said district 1-19 attorney. They shall have the same power as a sheriff to 1-20 make arrests, to execute and return all criminal warrants 1-21 and processes, and to serve as peace officers; and they 1-22 shall be subpoena clerks in the superior court for the 1-23 purpose of summoning witnesses before the grand jury. One 1-24 of the investigators shall be designated the chief 1-25 investigator, and his or her duties shall include 1-26 supervision of the remaining investigators and such other 1-27 duties as may be assigned by the district attorney. The 1-28 chief investigator shall receive as compensation for the 1-29 performance of such duties a sum of not less than 1-30 $10,774.56 nor more than $59,545.20 per annum, the exact 1-31 amount to be determined by the district attorney. The 1-32 compensation shall be paid in equal monthly installments -1- (Index) LC 24 0171 2- 1 from the general funds of Cobb County, Georgia. The 2- 2 remaining investigators shall receive as compensation for 2- 3 the performance of such duties a sum of not less than 2- 4 $10,774.56 nor more than $43,305.60 per annum, the exact 2- 5 amount to be determined by the district attorney. The 2- 6 compensation shall be paid in equal monthly installments 2- 7 from the general funds of Cobb County." SECTION 2. 2- 8 Said Act is further amended by striking Section 4B in its 2- 9 entirety and substituting in lieu thereof a new Section 4B 2-10 to read as follows: "SECTION 4B. 2-11 The district attorney is authorized to appoint, in 2-12 addition to those assistant district attorneys otherwise 2-13 provided by law, 14 full-time or part-time assistant 2-14 district attorneys who shall serve at the pleasure of the 2-15 district attorney and who shall assist the district 2-16 attorney in the performance of his or her duties. All 2-17 assistant district attorneys shall have been admitted to 2-18 the practice of law in all of the courts of the State of 2-19 Georgia and be members in good standing of the State Bar 2-20 of Georgia. All assistant district attorneys shall be 2-21 compensated in the sum of not less than $20,770.88 nor 2-22 more than $68,206.32 per annum, except that the chief 2-23 assistant district attorney shall receive no more than 2-24 $70,371.60 per annum. The exact amount of said 2-25 compensation shall be determined by the district attorney 2-26 of the Cobb Judicial Circuit. Said sum shall be payable 2-27 in equal monthly installments from the general funds of 2-28 said county, with the exception that whenever the State of 2-29 Georgia shall provide the compensation to any of the 2-30 assistant district attorneys, the amount of state 2-31 compensation shall be deducted from the total salary paid 2-32 from the general funds of Cobb County, Georgia." SECTION 3. 2-33 This Act shall become effective on the first day of the 2-34 month following the month in which it is approved by the 2-35 Governor or in which it becomes law without such approval. SECTION 4. 2-36 All laws and parts of laws in conflict with this Act are 2-37 repealed. -2- (Index)
