HB 979 LC 21 3366 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act entitled "An Act to create a new charter for 1- 2 the City of Statesboro," approved March 26, 1987 (Ga. L. 1- 3 1987, p. 4557), as amended, so as to provide for the 1- 4 appointment of certain committees; to provide for certain 1- 5 duties of the mayor; to provide for certain officers and 1- 6 employees of the city; to provide for oaths and bonds; to 1- 7 provide for a city clerk; to repeal conflicting laws; and 1- 8 for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 An Act entitled "An Act to create a new charter for the City 1-11 of Statesboro," approved March 26, 1987 (Ga. L. 1987, p. 1-12 4557), as amended, is amended by inserting at the end of 1-13 Article II the following: 1-14 "SECTION 2-6. Committees. 1-15 (a) The mayor and city council shall create by ordinance 1-16 such committees as they deem necessary to oversee the 1-17 operation and provision of city services and the 1-18 administration of city government. The following 1-19 committees shall be standing committees: property, 1-20 police, fire, streets, sanitation, natural gas, water and 1-21 sewer, waste water, finance, and solid waste disposal. 1-22 The mayor shall establish additional ad hoc committees as 1-23 he or she deems necessary. Each committee shall consist 1-24 of a chair and one other councilmember, with terms set and 1-25 appointments being made by the mayor. 1-26 (b) Each committee provided for in this section shall meet 1-27 periodically with the city administrator and department 1-28 heads and other appropriate employees or appointees from 1-29 the committee's assigned area of services. The committee 1-30 shall recommend to the mayor and city council such 1-31 policies and measures deemed necessary and expedient for 1-32 the health, safety, and welfare of the city or for the -1- (Index) LC 21 3366 2- 1 implementation or improvement of the provisions of city 2- 2 services. Each committee shall oversee and recommend the 2- 3 preparation of annual budgetary requests to the mayor and Statesboro, City of; amend provisions979hb979ea of 2- 5 services. Each committee shall also review bids; review 2- 6 and recommend major construction and infrastructure 2- 7 repairs and improvements; hear policy appeals related to 2- 8 its department or assigned area of services; and perform 2- 9 such other duties required by the mayor and city council." SECTION 2. 2-10 Said Act is further amended by striking in its entirety 2-11 Article III and inserting in lieu thereof the following: 2-12 "ARTICLE III. SECTION 3.1 2-13 Mayor's duties. 2-14 The mayor shall serve as the chief executive officer of 2-15 the City of Statesboro. The mayor's duties shall include 2-16 the following: 2-17 (1) To preside at all meetings of the city council and 2-18 perform such other duties consistent with the office as 2-19 may be imposed by the city council. The mayor shall 2-20 have a voice on all matters before the city council but 2-21 shall vote only in the event of a tie. The mayor may 2-22 use the title of mayor in any case in which the 2-23 execution of legal instruments of writing or other 2-24 necessity arising where the general laws of the state or 2-25 provisions of this charter so require; 2-26 (2) To act as the official head of the city for the 2-27 purpose of serving civil process, for the purpose of 2-28 military law, and for all ceremonial purposes. In times 2-29 of danger and emergency, the mayor may, with the consent 2-30 of the council, take command of the police and govern 2-31 the city by proclamation and maintain order and enforce 2-32 laws. In the event the President of the United States 2-33 or the Governor declares such an emergency to exist, the 2-34 mayor may take command of the police and govern the city 2-35 by proclamation and maintain order and enforce laws 2-36 until such time as the city council is able to convene; 2-37 (3) To have general jurisdiction over and supervision of 2-38 the affairs of the city and the provision of services 2-39 and the authority to inspect the books, papers, 2-40 information, and documents of any agent, employee, or -2- (Index) LC 21 3366 3- 1 officer of the city. The mayor shall give the city 3- 2 council information relative to the affairs of the city 3- 3 and shall recommend for the consideration of the council 3- 4 such measures as may be deemed fit; 3- 5 (4) To see that all laws and ordinances are enforced; 3- 6 (5) To keep city council advised as to the financial 3- 7 condition and needs of the city and to make such 3- 8 recommendations as deemed desirable; 3- 9 (6) To recommend to the city council from time to time 3-10 the adoption of such measures as deemed necessary or 3-11 expedient for the health, safety, and welfare of the 3-12 city or for the improvement of administrative services; 3-13 and 3-14 (7) To perform such other duties as may be prescribed in 3-15 this charter may be required by ordinance or resolution 3-16 of the mayor and council. SECTION 3-2. 3-17 Officers and employees. 3-18 (a) The mayor and city council shall have the power to 3-19 appoint and, when necessary, to suspend a city clerk, city 3-20 treasurer, city attorney, city engineer, city auditor, 3-21 city administrator, and such other officers and employees 3-22 as are deemed necessary for the efficient administration 3-23 and operation of the city government and the provision of 3-24 services. The mayor and city council shall have the power 3-25 to create departments, offices, and agencies necessary for 3-26 the administration of government and provision of services 3-27 and to delegate to a city administrator or the head of a 3-28 department, office, or agency the power to appoint, 3-29 suspend, or remove subordinates in such department, 3-30 agency, or office; provided, however, that such 3-31 appointments, suspensions, or removals shall be subject to 3-32 the personnel policies adopted by the mayor and city 3-33 council and may further be susperseded by affirmative 3-34 action of the city council within 30 days of occurrence. 3-35 The appointment, suspension, or removal of a city 3-36 administrator, any department head, the city clerk, the 3-37 city engineer, city attorney, and city auditor shall be 3-38 made directly by the mayor and city council, which shall 3-39 establish a procedure for recruitment and review of 3-40 candidates for open positions. -3- (Index) LC 21 3366 4- 1 (b) The mayor and city council may, in their discretion, 4- 2 create the administrative office of a city administrator. 4- 3 The city administrator's duties shall be established by 4- 4 the policy set by the mayor and city council. The city 4- 5 administrator shall be further subject to the direction 4- 6 and control of the mayor as the chief executive and 4- 7 administrative officer of the City of Statesboro. In 4- 8 addition to the duties established by the policy of the 4- 9 mayor and city council, the mayor may delegate such 4-10 administrative duties as he or she deems necessary to the 4-11 city administrator. SECTION 3.3. 4-12 Oaths, bonds. 4-13 All officers, employees, and appointees shall take an oath 4-14 to perform faithfully the duties of their respective offices 4-15 and give such bond and security as may be required and set 4-16 by the mayor and city council. SECTION 3.4. City clerk. 4-17 The clerk of the city council of the city shall be ex 4-18 officio treasurer of the city and shall be ex officio a 4-19 member of the board of tax assessors of the city, and the 4-20 duties of the office shall be prescribed by the mayor and 4-21 city council. The clerk shall be required to give such bond 4-22 and security as the city council may fix, conditioned upon 4-23 faithful performance of the duties of treasurer of the city; 4-24 provided, however, that the mayor and city council shall 4-25 retain authority to separate by ordinance the office of 4-26 clerk and treasurer, prescribe duties of each office, fix 4-27 salaries, and require bonds and security." SECTION 3. 4-28 All laws and parts of laws in conflict with this Act are 4-29 repealed. -4- (Index)
