HR 10 LC 22 1356 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to provide 1- 2 for limitations on the number of consecutive full terms of 1- 3 office which may be served by members of the House of 1- 4 Representatives and Senate of the State of Georgia, the 1- 5 Lieutenant Governor, the Secretary of State, the Attorney 1- 6 General, the State School Superintendent, the Commissioner 1- 7 of Insurance, the Commissioner of Agriculture, the 1- 8 Commissioner of Labor, and members of the Public Service 1- 9 Commission; to provide for the submission of this amendment 1-10 for ratification or rejection; and for other purposes. 1-11 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-12 Article III, Section II of the Constitution is amended by 1-13 striking in its entirety subparagraph (a) of Paragraph V and 1-14 inserting in its place a new subparagraph to read as 1-15 follows: 1-16 "(a)(1) The members of the General Assembly shall be 1-17 elected by the qualified electors of their respective 1-18 districts for a term of two years and shall serve until 1-19 the time fixed for the convening of the next General 1-20 Assembly. 1-21 (2) No member of the House of Representatives of the 1-22 State of Georgia who has served four consecutive full 1-23 two-year terms of office which began on or after January 1-24 1, 1997, shall again be eligible to hold office as a 1-25 member of the House of Representatives of the State of 1-26 Georgia until after the expiration of four years from 1-27 the conclusion of that person's last term of office. 1-28 (3) No member of the Senate of the State of Georgia 1-29 who has served four consecutive full two-year terms of 1-30 office which began on or after January 1, 1997, shall 1-31 again be eligible to hold office as a member of the 1-32 Senate of the State of Georgia until after the 1-33 expiration of four years from the conclusion of that 1-34 person's last term of office." -1- (Index) LC 22 1356 SECTION 2. 2- 1 Article IV, Section I, Paragraph I of the Constitution is 2- 2 amended by striking subparagraph (a) and inserting in its 2- 3 place a new subparagraph (a) to read as follows: 2- 4 "(a) There shall be a Public Service Commission for the 2- 5 regulation of utilities which shall consist of five 2- 6 members who shall be elected by the people. The 2- 7 Commissioners in office on June 30, 1983, shall serve 2- 8 until December 31 after the general election at which the 2- 9 successor of each member is elected. Thereafter, all 2-10 succeeding terms of members shall be for six years. No 2-11 member who has served two consecutive full six-year terms 2-12 of office which began on or after January 1, 1997, as a 2-13 member of the Public Service Commission shall again be 2-14 eligible to hold office as a member of that body until 2-15 after the expiration of six years from the conclusion of 2-16 that person's last term of office. Members shall serve 2-17 until their successors are elected and qualified. A 2-18 chairman chairperson shall be selected by the members of 2-19 the commission from its membership." SECTION 3. 2-20 Article V, Section I of the Constitution is amended by 2-21 striking Paragraph III and inserting in its place a new 2-22 Paragraph III to read as follows: 2-23 "Paragraph III. Lieutenant Governor. There shall be a 2-24 Lieutenant Governor, who shall be elected at the same 2-25 time, for the same term, and in the same manner as the 2-26 Governor. A person who has served two consecutive full 2-27 four-year terms of office which began on or after January 2-28 1, 1997, as Lieutenant Governor shall not again be 2-29 eligible to hold such office until after the expiration of 2-30 four years from the conclusion of that person's last term 2-31 of office. The Lieutenant Governor shall be the President 2-32 of the Senate and shall have such executive duties as 2-33 prescribed by the Governor and as may be prescribed by law 2-34 not inconsistent with the powers of the Governor or other 2-35 provisions of this Constitution. The compensation and 2-36 allowances of the Lieutenant Governor shall be as provided 2-37 by law." -2- (Index) LC 22 1356 SECTION 4. 3- 1 Article V, Section III of the Constitution is amended by 3- 2 striking Paragraph I and inserting in its place a new 3- 3 Paragraph I to read as follows: 3- 4 "Paragraph I. Other executive officers, how elected. 3- 5 The Secretary of State, Attorney General, State School 3- 6 Superintendent, Commissioner of Insurance, Commissioner of 3- 7 Agriculture, and Commissioner of Labor shall be elected in 3- 8 the manner prescribed for the election of members of the 3- 9 General Assembly and the electors shall be the same. Such 3-10 executive officers shall be elected at the same time and 3-11 hold their offices for the same term as the Governor. No 3-12 person who has served two consecutive full four-year terms 3-13 of office which began on or after January 1, 1997, as 3-14 Secretary of State, Attorney General, State School 3-15 Superintendent, Commissioner of Insurance, Commissioner of 3-16 Agriculture, or Commissioner of Labor shall again be 3-17 eligible to hold the office in which that person last so 3-18 served until after the expiration of four years from the 3-19 conclusion of that person's last term of office." SECTION 5. 3-20 The above proposed amendment to the Constitution shall be 3-21 published and submitted as provided in Article X, Section I, 3-22 Paragraph II of the Constitution. 3-23 The ballot submitting the above proposed amendment shall 3-24 have written or printed thereon the following: 3-25 "( ) YES Shall the Constitution be amended so as to 3-26 limit members of the General Assembly of the 3-27 ( ) NO State of Georgia to serving four consecutive 3-28 full terms of office; to limit the Lieutenant 3-29 Governor, Secretary of State, Attorney 3-30 General, State School Superintendent, 3-31 Commissioner of Insurance, Commissioner of 3-32 Agriculture, Commissioner of Labor, and 3-33 members of the Public Service Commission to 3-34 serving two consecutive full terms of office?" 3-35 All persons desiring to vote in favor of ratifying the 3-36 proposed amendment shall vote "Yes." All persons desiring 3-37 to vote against ratifying the proposed amendment shall vote 3-38 "No." -3- (Index) LC 22 1356 4- 1 If such amendment shall be ratified as provided in said 4- 2 Paragraph of the Constitution, it shall become a part of the 4- 3 Constitution of this state. -4- (Index)
