A RESOLUTION
1- 1 Authorizing the conveyance of certain state owned real
1- 2 property located in Richmond County, Georgia; to provide for
1- 3 the conveyance of said property back to the State of Georgia
1- 4 under certain conditions; to provide an effective date; to
1- 5 repeal conflicting laws; and for other purposes.
1- 6 WHEREAS, the State of Georgia is the owner of a certain
1- 7 parcel of real property located in Richmond County, Georgia;
1- 8 and
1- 9 WHEREAS, said real property is all that tract or parcel of
1-10 land lying and being in Richmond County, Georgia, lying on
1-11 Phinizy Road, containing approximately five acres, and will
1-12 be more particularly described on a plat of survey prepared
1-13 by a Georgia registered land surveyor and presented by
1-14 Richmond County to the State Properties Commission for
1-15 approval; and
1-16 WHEREAS, Richmond County currently provides the site for the
1-17 Department of Public Safety driver's license testing
1-18 facility; and
1-19 WHEREAS, Richmond County is in need of the current driver's
1-20 license testing site for inclusion into a proposed minor
1-21 league baseball facility; and
1-22 WHEREAS, Richmond County has agreed to construct on the
1-23 above-described state owned property a new public safety
1-24 driver's license testing facility to serve the citizens of
1-25 Richmond County and surrounding areas.
1-26 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL
1-27 ASSEMBLY OF GEORGIA:
SECTION 1.
1-28 That the State of Georgia is the owner of the
1-29 above-described real property and that in all matters
1-30 relating to the conveyance of the real property the State of
1-31 Georgia is acting by and through its State Properties
1-32 Commission.

SECTION 2.
2- 1 That the above-described real property shall be conveyed by
2- 2 appropriate instrument to Richmond County by the State of
2- 3 Georgia, acting by and through the State Properties
2- 4 Commission, for the purpose of constructing a driver's
2- 5 license testing facility and for a consideration of $10.00
2- 6 and the agreement of Richmond County to comply with Section
2- 7 3 of this resolution and such further consideration and
2- 8 provisions as the State Properties Commission shall in its
2- 9 discretion determine to be in the best interests of the
2-10 State of Georgia.
SECTION 3.
2-11 That upon completion of the above-described driver's license
2-12 testing facility, Richmond County shall convey back to the
2-13 State of Georgia the above-described property with
2-14 improvements for a consideration of $10.00.
SECTION 4.
2-15 That the authorization in this resolution to convey the
2-16 above-described property to Richmond County shall expire
2-17 three years after the date that this resolution becomes
2-18 effective.
SECTION 5.
2-19 That the State Properties Commission is authorized and
2-20 empowered to do all acts and things necessary and proper to
2-21 effect such conveyance.
SECTION 6.
2-22 That the deed of conveyance shall be recorded by the
2-23 purchaser in the Superior Court of Richmond County and a
2-24 recorded copy shall be forwarded to the State Properties
2-25 Commission.
SECTION 7.
2-26 That this resolution shall become effective upon its
2-27 approval by the Governor or upon its becoming law without
2-28 such approval.
SECTION 8.
2-29 That all laws and parts of laws in conflict with this
2-30 resolution are repealed.
