HR 329 LC 9 8238 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to 1- 2 authorize the General Assembly to prescribe juries of six 1- 3 persons in all civil cases in all courts; to provide for the 1- 4 submission of this amendment for ratification or rejection; 1- 5 and for other purposes. 1- 6 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 7 Article I, Section I, Paragraph XI of the Constitution is 1- 8 amended by striking subsection (b) and inserting a new 1- 9 subsection to read as follows: 1-10 "(b) A trial jury shall consist of 12 persons; but the 1-11 General Assembly may prescribe any number, not less than 1-12 six, to constitute a trial jury a jury of six persons in 1-13 all courts in all civil cases, in courts of limited 1-14 jurisdiction in any cases, and in superior courts in 1-15 misdemeanor cases." SECTION 2. 1-16 The above proposed amendment to the Constitution shall be 1-17 published and submitted as provided in Article X, Section I, 1-18 Paragraph II of the Constitution. 1-19 The ballot submitting the above proposed amendment shall 1-20 have written or printed thereon the following: 1-21 "( ) YES Shall the Constitution be amended so as to 1-22 authorize the General Assembly to prescribe a 1-23 ( ) NO jury of six in all civil cases in all courts?" 1-24 All persons desiring to vote in favor of ratifying the 1-25 proposed amendment shall vote "Yes." All persons desiring 1-26 to vote against ratifying the proposed amendment shall vote 1-27 "No." 1-28 If such amendment shall be ratified as provided in said 1-29 Paragraph of the Constitution, it shall become a part of the 1-30 Constitution of this state. -1- (Index)
