HR 33 LC 16 3896 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to limit 1- 2 members of the General Assembly to six consecutive two-year 1- 3 terms of office and to limit the Lieutenant Governor, 1- 4 Secretary of State, Attorney General, State School 1- 5 Superintendent, Commissioner of Insurance, Commissioner of 1- 6 Agriculture, and Commissioner of Labor to three consecutive 1- 7 four-year terms of office; to provide for the submission of 1- 8 this amendment for ratification or rejection; and for other 1- 9 purposes. 1-10 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Article III, Section II, Paragraph V of the Constitution is 1-12 amended by adding at the end a new subparagraph to read as 1-13 follows: 1-14 "(d) No member of the General Assembly who has served 1-15 six consecutive full two-year terms of office which began 1-16 on or after January 1, l995, as a member of the Senate or 1-17 House of Representatives of this state shall again be 1-18 eligible to hold office in that body in which that person 1-19 last so served until after the expiration of two years 1-20 from the conclusion of that person's last term of office." SECTION 2. 1-21 Article V, Section I of the Constitution is amended by 1-22 striking Paragraph III thereof and inserting in its place a 1-23 new Paragraph to read as follows: 1-24 "Paragraph III. Lieutenant Governor. There shall be a 1-25 Lieutenant Governor, who shall be elected at the same 1-26 time, for the same term, and in the same manner as the 1-27 Governor. The Lieutenant Governor shall be the President 1-28 of the Senate and shall have such executive duties as 1-29 prescribed by the Governor and as may be prescribed by law 1-30 not inconsistent with the powers of the Governor or other 1-31 provisions of this Constitution. The compensation and 1-32 allowances of the Lieutenant Governor shall be as provided 1-33 by law. A person who has served three consecutive full -1- (Index) LC 16 3896 2- 1 four-year terms of office which began on or after January 2- 2 1, l995, as Lieutenant Governor shall not again be 2- 3 eligible to hold such office until after the expiration of 2- 4 four years from the conclusion of that person's last term 2- 5 of office." SECTION 3. 2- 6 Article V, Section III, Paragraph II of the Constitution is 2- 7 amended by adding at the end a new subparagraph to read as 2- 8 follows: 2- 9 "(c) No person who has served three consecutive full 2-10 four-year terms of office which began on or after January 2-11 1, l995, as Secretary of State, Attorney General, State 2-12 School Superintendent, Commissioner of Insurance, 2-13 Commissioner of Agriculture, or Commissioner of Labor 2-14 shall again be eligible to hold the office in which that 2-15 person last so served until after the expiration of four 2-16 years from the conclusion of that person's last term of 2-17 office." SECTION 4. 2-18 The above proposed amendment to the Constitution shall be 2-19 published and submitted as provided in Article X, Section I, 2-20 Paragraph II of the Constitution. 2-21 The ballot submitting the above proposed amendment shall 2-22 have written or printed thereon the following: 2-23 "( ) YES Shall the Constitution be amended so as to 2-24 limit members of the General Assembly to six 2-25 ( ) NO consecutive two-year terms of office and to 2-26 limit the Lieutenant Governor, Secretary of 2-27 State, Attorney General, State School 2-28 Superintendent, Commissioner of Insurance, 2-29 Commissioner of Agriculture, and Commissioner 2-30 of Labor to three consecutive four-year terms 2-31 of office?" 2-32 All persons desiring to vote in favor of ratifying the 2-33 proposed amendment shall vote "Yes." All persons desiring 2-34 to vote against ratifying the proposed amendment shall vote 2-35 "No." 2-36 If such amendment shall be ratified as provided in said 2-37 Paragraph of the Constitution, it shall become a part of the 2-38 Constitution of this state. -2- (Index)
