A RESOLUTION
1- 1 Authorizing the conveyance of certain state owned real
1- 2 property located in Stephens County, Georgia; to provide an
1- 3 effective date; to repeal conflicting laws; and for other
1- 4 purposes.
1- 5 WHEREAS, the State of Georgia is the owner of a certain
1- 6 parcel of real property located in Stephens County, Georgia;
1- 7 and
1- 8 WHEREAS, said real property, which was intended to be the
1- 9 location of a proposed maintenance facility for the National
1-10 Guard Armory, is all that tract or parcel of land containing
1-11 1.47 acres lying and being in the City of Toccoa, Stephens
1-12 County, Georgia, and is more particularly described in a
1-13 plat of survey entitled "Georgia Army National Guard" dated
1-14 February 14, 1986, by Clelland A. Tyson, Georgia Registered
1-15 Land Surveyor No. 1515, on file with the State Properties
1-16 Commission; and
1-17 WHEREAS, said property is under the custody of the Georgia
1-18 Department of Defense; and
1-19 WHEREAS, the Department of Defense no longer intends to
1-20 construct the above-mentioned maintenance facility and the
1-21 property is not being utilized by the State of Georgia and
1-22 is therefore surplus to its needs; and
1-23 WHEREAS, the Stephens County Board of Education conveyed the
1-24 above-described property to the State of Georgia on
1-25 September 18, 1986, for the consideration of $10.00; and
1-26 WHEREAS, the Stephens County Board of Education is desirous
1-27 of obtaining the subject property.
1-28 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL
1-29 ASSEMBLY OF GEORGIA:
SECTION 1.
1-30 That the State of Georgia is the owner of the
1-31 above-described real property and that in all matters
1-32 relating to the conveyance of the real property the State of
1-33 Georgia is acting by and through its State Properties
1-34 Commission.

SECTION 2.
2- 1 That the above-described real property shall be conveyed by
2- 2 appropriate instrument to the Stephens County Board of
2- 3 Education by the State of Georgia, acting by and through the
2- 4 State Properties Commission, for a consideration of $10.00
2- 5 and such further consideration and provisions as the State
2- 6 Properties Commission shall in its discretion determine to
2- 7 be in the best interests of the State of Georgia.
SECTION 3.
2- 8 That the authorization in this resolution to convey the
2- 9 above-described property to the Stephens County Board of
2-10 Education shall expire three years after the date that this
2-11 resolution becomes effective.
SECTION 4.
2-12 That the State Properties Commission is authorized and
2-13 empowered to do all acts and things necessary and proper to
2-14 effect such conveyance.
SECTION 5.
2-15 That the deed of conveyance shall be recorded by the grantee
2-16 in the Superior Court of Stephens County and a recorded copy
2-17 shall be forwarded to the State Properties Commission.
SECTION 6.
2-18 That this resolution shall become effective upon its
2-19 approval by the Governor or upon its becoming law without
2-20 such approval.
SECTION 7.
2-21 That all laws and parts of laws in conflict with this
2-22 resolution are repealed.
