HR 388 LC 21 3315 A RESOLUTION 1- 1 Authorizing the conveyance of certain state owned real 1- 2 property located in Worth County, Georgia; to provide an 1- 3 effective date; to repeal conflicting laws; and for other 1- 4 purposes. 1- 5 WHEREAS, the State of Georgia is the owner of a certain 1- 6 parcel of real property located in the City of Poulan, Worth 1- 7 County, Georgia; and 1- 8 WHEREAS, said real property is all that tract or parcel of 1- 9 land lying and being in the City of Poulan, Worth County, 1-10 Georgia, containing approximately 7 acres lying and being in 1-11 Land Lot 337 of the 7th District as described on that 1-12 drawing entitled "Possum Poke Roadside Park" dated 1953 and 1-13 on file in the offices of the State Properties Commission; 1-14 and may be more particularly described on a plat of survey 1-15 prepared by a Georgia Registered Land Surveyor and presented 1-16 by the Grantee to the State Properties Commission for 1-17 approval; and 1-18 WHEREAS, said property was originally in the custody of the 1-19 Georgia Department of Natural Resources by virtue of a deed 1-20 dated March 24, 1948; and 1-21 WHEREAS, said property was subsequently deeded by the 1-22 original grantor to the Board of Regents by virtue of a deed 1-23 dated April 25, 1966; and 1-24 WHEREAS, life estate to the above-described property was 1-25 deeded to the Department of Transportation by virtue of a 1-26 deed dated May 11, 1953; and 1-27 WHEREAS, the Department of Natural Resources has declared 1-28 the property surplus to its needs; and 1-29 WHEREAS, the City of Poulan, Worth County, is desirous of 1-30 obtaining the subject property. 1-31 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL 1-32 ASSEMBLY OF GEORGIA: -1- (Index) LC 21 3315 SECTION 1. 2- 1 That the State of Georgia is the owner of the 2- 2 above-described real property and that in all matters 2- 3 relating to the conveyance of the real property the State of 2- 4 Georgia is acting by and through its State Properties 2- 5 Commission. SECTION 2. 2- 6 That the above-described real property shall be conveyed by 2- 7 appropriate instrument to the City of Poulan, Worth County, 2- 8 by the State of Georgia, acting by and through the State 2- 9 Properties Commission, for the consideration of $10.00 so 2-10 long as the property is used for public purposes and such 2-11 further consideration and provisions as the State Properties 2-12 Commission shall in its discretion determine to be in the 2-13 best interest of the State of Georgia. SECTION 3. 2-14 That the authorization in this resolution to convey the 2-15 above-described property to the City of Poulan, Worth 2-16 County, shall expire three years after the date that this 2-17 resolution becomes effective. SECTION 4. 2-18 That the State Properties Commission is authorized and 2-19 empowered to do all acts and things necessary and proper to 2-20 effect such conveyance. SECTION 5. 2-21 That the deed of conveyance shall be recorded by the Grantee 2-22 in the Superior Court of Worth County and a recorded copy 2-23 shall be forwarded to the State Properties Commission. SECTION 6. 2-24 That this resolution shall become effective upon its 2-25 approval by the Governor or upon its becoming law without 2-26 such approval. SECTION 7. 2-27 That all laws and parts of laws in conflict with this Act 2-28 are repealed. -2- (Index)
