HR 58 LC 21 2955 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to provide 1- 2 that the Public Service Commission shall be composed of as 1- 3 many members as there are congressional members in the 1- 4 state; to provide that the members from each congressional 1- 5 district shall be elected by the electors residing within 1- 6 each such district voting in the election; to provide for 1- 7 the submission of this amendment for ratification or 1- 8 rejection; and for other purposes. 1- 9 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Article IV, Section I, Paragraph I of the Constitution is 1-11 amended by striking in its entirety subparagraph (a) and 1-12 inserting in lieu thereof the following: 1-13 "Paragraph I. Public Service Commission. (a) There 1-14 shall be a Public Service Commission for the regulation of 1-15 utilities which shall consist of five as many members as 1-16 there are congressional districts in the state who shall 1-17 be elected by the people. The member of the board from 1-18 each congressional district shall be elected by a majority 1-19 vote of the electors residing within each such district 1-20 voting in the election. The Commissioners in office on 1-21 June 30, 1983 January 1, 1996, shall serve until December 1-22 31 after the general election at which the successor of 1-23 each member is elected June 30, 1997, and the members 1-24 elected pursuant to this subparagraph shall take office on 1-25 July 1, 1997. Thereafter, all succeeding terms of members 1-26 shall be for six years. Members shall serve until their 1-27 successors are elected and qualified. A chairman 1-28 chairperson shall be selected by the members of the 1-29 commission from its membership." SECTION 2. 1-30 The above proposed amendment to the Constitution shall be 1-31 published and submitted as provided in Article X, Section I, 1-32 Paragraph II of the Constitution. -1- (Index) LC 21 2955 2- 1 The ballot submitting the above proposed amendment shall 2- 2 have written or printed thereon the following: 2- 3 "( ) YES Shall the Constitution be amended so as to 2- 4 provide that the Public Service Commission 2- 5 ( ) NO shall be made up of as many members as there 2- 6 are congressional districts in the state, to 2- 7 be elected by the members of the Georgia 2- 8 General Assembly whose districts fall wholly 2- 9 or partially within the congressional 2-10 district?" 2-11 All persons desiring to vote in favor of ratifying the 2-12 proposed amendment shall vote "Yes." All persons desiring 2-13 to vote against ratifying the proposed amendment shall vote 2-14 "No." 2-15 If such amendment shall be ratified as provided in said 2-16 Paragraph of the Constitution, it shall become a part of the 2-17 Constitution of this state. -2- (Index)
