HR 59 LC 21 2952 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to 1- 2 authorize the General Assembly to provide by general law for 1- 3 a State Compensation Board; to provide for the compensation, 1- 4 appointment, and terms of the board members; to provide that 1- 5 the board shall meet biennially to establish the salaries of 1- 6 certain elected positions; to provide that such 1- 7 determination shall be binding on the General Assembly; to 1- 8 provide for the establishment of an initial salary; to 1- 9 provide a restriction on the effective date of any salary 1-10 increase; to provide for the submission of this amendment 1-11 for ratification or rejection; and for other purposes. 1-12 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Article IV of the Constitution is amended by striking in its 1-14 entirety Paragraph II of Section VII and inserting in lieu 1-15 thereof the following: 1-16 "Paragraph II. Powers and duties. The powers and duties 1-17 of members of constitutional boards and commissions 1-18 provided for in this article, except the Board of Pardons 1-19 and Paroles and the State Compensation Board, shall be as 1-20 provided by law." SECTION 2. 1-21 Said Article is further amended by inserting at the end 1-22 thereof a new section to read as follows: 1-23 "SECTION VIII 1-24 STATE COMPENSATION BOARD 1-25 Paragraph I. State Compensation Board. (a) The General 1-26 Assembly may provide by general law for a State 1-27 Compensation Board which shall be composed of as many 1-28 members as there are congressional districts in the state 1-29 and who shall serve for terms of six years. The members 1-30 of the board from each congressional district shall be 1-31 appointed by the Governor subject to confirmation by the 1-32 Senate. -1- (Index) LC 21 2952 2- 1 (b) The State Compensation Board shall meet biennially 2- 2 beginning in January, 1997, and shall establish the 2- 3 salaries of the Governor, Lieutenant Governor, Speaker of 2- 4 the House of Representatives, members of the General 2- 5 Assembly, and each constitutional officer. The 2- 6 determination by the State Compensation Board shall be 2- 7 binding on the General Assembly. 2- 8 (c) At the first meeting, the council shall establish 2- 9 the initial salaries, which shall not be less than the 2-10 salaries in effect at the time of the first meeting. 2-11 Thereafter, the commission may increase but may not reduce 2-12 the salaries; provided, however, that no increase shall 2-13 become effective during the term of office in effect at 2-14 the time the increase was granted." SECTION 3. 2-15 The above proposed amendment to the Constitution shall be 2-16 published and submitted as provided in Article X, Section I, 2-17 Paragraph II of the Constitution. 2-18 The ballot submitting the above proposed amendment shall 2-19 have written or printed thereon the following: 2-20 "( ) YES Shall the Constitution be amended so as to 2-21 provide for the State Compensation Board, 2-22 ( ) NO which shall meet every two years to set the 2-23 salaries of the Governor, Lieutenant Governor, 2-24 Speaker of the House of Representatives, 2-25 members of the General Assembly, and each 2-26 constitutional officer?" 2-27 All persons desiring to vote in favor of ratifying the 2-28 proposed amendment shall vote "Yes." All persons desiring 2-29 to vote against ratifying the proposed amendment shall vote 2-30 "No." 2-31 If such amendment shall be ratified as provided in said 2-32 Paragraph of the Constitution, it shall become a part of the 2-33 Constitution of this state. -2- (Index)
