SENATE BILL 11

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 20 of the Official Code of
1- 2 Georgia Annotated, relating to elementary, secondary, and
1- 3 adult education, so as to provide that contractors,
1- 4 officials, agents, or other appropriate representatives of
1- 5 the Department of Public Safety may teach the alcohol and
1- 6 drug course; to change certain provisions regarding
1- 7 curriculum-based assessments; to repeal conflicting laws;
1- 8 and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-10 Chapter 2 of Title 20 of the Official Code of Georgia
1-11 Annotated, relating to elementary, secondary, and adult
1-12 education, is amended in Code Section 20-2-142, relating to
1-13 prescribed courses in public schools, by striking in its
1-14 entirety paragraph (1) of subsection (b) and inserting in
1-15 lieu thereof the following:
1-16 "(b)(1) The State Board of Education and the Board of
1-17 Public Safety shall jointly establish an alcohol and
1-18 drug course for the purpose of informing the young
1-19 people of this state of the dangers involved in
1-20 consuming alcohol or certain drugs in connection with
1-21 the operation of a motor vehicle. The course shall be
1-22 designed to generate greater interest in highway safety
1-23 and accident prevention. The state board and the Board
1-24 of Public Safety shall jointly, by rules or regulations,
1-25 determine the contents of the course and its duration.
1-26 The Board Commissioner of Public Safety shall make
1-27 available officers, or employees, officials, agents,
1-28 contractors, or other appropriate representatives as
1-29 determined by the commissioner of the Department of
1-30 Public Safety to teach the alcohol and drug course. The
1-31 alcohol and drug course shall be offered periodically
1-32 but not less than once annually in the public schools of
1-33 this state to students in grades nine and above in the
1-34 manner prescribed by the state board."

SECTION 2.
2- 1 Said chapter is further amended by striking in its entirety
2- 2 Code Section 20-2-281, relating to assessments of
2- 3 educational programs, and inserting in its place a new Code
2- 4 section to read as follows:
2- 5 "20-2-281. (Index)
2- 6 (a) The State Board of Education shall adopt a student
2- 7 assessment program consisting of instruments, procedures,
2- 8 and policies necessary to assess the effectiveness of the
2- 9 educational programs of the state implement the program
2-10 and shall fund all costs of providing and scoring such
2-11 instruments, subject to appropriation by the General
2-12 Assembly. Curriculum-based assessments of the quality
2-13 core curriculum and nationally Nationally norm-referenced
2-14 instruments in reading, and mathematics, science, and
2-15 social studies shall be administered to students in grades
2-16 three, five, and eight, and 11. The State Board of
2-17 Education shall review, revise, and upgrade the quality
2-18 core curriculum. Following the adoption of this revised
2-19 curriculum, the State Board of Education shall contract
2-20 for development of criterion-referenced tests to measure
2-21 the quality core curriculum and such tests shall be
2-22 administered to students in three grades not lower than
2-23 grade three. This action shall be completed within two
2-24 years. A curriculum-based assessment shall be administered
2-25 in grade 11 for graduation purposes. Only the
2-26 curriculum-based assessments in grades three, five, and
2-27 eight and the eleventh grade norm-referenced instrument
2-28 may be administered by matrix sample. Writing assessments
2-29 shall be administered to students in grades three, five,
2-30 eight, and 11. The writing assessments shall provide
2-31 students and their parents with performance outcome
2-32 measures resulting from the administration of such tests.
2-33 The curriculum-based assessments that the state board
2-34 shall develop shall measure student performance relative
2-35 to the uniformly sequenced core curriculum approved for
2-36 grades three, five, eight, and 11 by the state board
2-37 pursuant to Code Section 20-2-140. The curriculum-based
2-38 assessments shall place emphasis upon reading, writing,
2-39 mathematics, science, and social studies. All such
2-40 curriculum-based assessments shall include process and
2-41 application skills as assessed in a range of academic
2-42 content, shall exceed minimum and essential skills by

3- 1 extending the assessments' range of difficulty, and shall
3- 2 emphasize higher order thinking skills.
3- 3 (b) The nationally normed assessments provided for in
3- 4 subsection (a) of this Code section shall provide students
3- 5 and their parents with grade equivalencies and percentile
3- 6 ranks which result from the administration of such tests.
3- 7 Curriculum-based assessments Criterion-referenced tests
3- 8 and the high school graduation test provided for in
3- 9 subsection (a) of this Code section shall provide for
3-10 results that reflect student achievement at the individual
3-11 student, classroom, school, system, and state levels. The
3-12 State Board of Education shall participate in the National
3-13 Assessment of Educational Progress (NAEP). The results of
3-14 such testing shall be provided to the Governor, the
3-15 General Assembly, and the State Board of Education and
3-16 shall be reported to the citizens of Georgia. Further,
3-17 the state board shall adopt a school readiness assessment
3-18 for students entering first grade and shall administer
3-19 such assessment pursuant to paragraph (2) of subsection
3-20 (b) of Code Section 20-2-151. The state board shall
3-21 develop, subject to appropriation by the General Assembly,
3-22 a comprehensive item bank which shall be representative of
3-23 grade levels three, five, eight, and 11 and content areas
3-24 contained within the uniformly sequenced core curriculum
3-25 approved by the state board for those grades pursuant to
3-26 Code Section 20-2-140; provided, however, that the items
3-27 reflecting each subject area at designated grade levels
3-28 shall range proportionally from minimal competency to
3-29 higher level achievement competencies. This item bank
3-30 shall be used to develop assessments which reflect student
3-31 achievement at the classroom, school, and system levels.
3-32 One of the components in both the comprehensive evaluation
3-33 pursuant to Code Section 20-2-282 and the awarding of
3-34 salary supplements as part of a pay for performance or
3-35 related plan pursuant to Code Section 20-2-213 or other
3-36 Code sections under this article may be assessments of
3-37 student achievement.
3-38 (c) The State Board of Education shall have the authority
3-39 to condition the promotion of a student from one grade to
3-40 the next or condition the awarding of a high school
3-41 diploma to a student upon achievement of satisfactory
3-42 scores on instruments or tests adopted and administered by
3-43 the state board pursuant to subsection (a) of this Code
3-44 section. The state board is authorized and directed to
3-45 adopt regulations providing that any handicapped child, as

4- 1 defined by the provisions of this article, shall be
4- 2 afforded opportunities to take any test adopted by the
4- 3 state board as a condition for the awarding of a high
4- 4 school diploma. Said regulations shall further provide for
4- 5 appropriate accommodations in the administration of such
4- 6 test. Said regulations shall further provide for the
4- 7 awarding of a special education diploma to any handicapped
4- 8 student who is lawfully assigned to a special education
4- 9 program and who does not achieve a passing score on said
4-10 test or who has not completed all of the requirements for
4-11 a high school diploma but who has nevertheless completed
4-12 his or her Individualized Education Program.
4-13 (d) Local school systems may not use state funds to
4-14 purchase or administer assessments other than those
4-15 specified in subsection (a) of this Code section. However,
4-16 local systems participating in state funded programs which
4-17 require, in part or whole, individual student assessment
4-18 data to determine eligibility or evaluation of student
4-19 success in such programs, or to meet mandated requirements
4-20 under federally authorized funds allocated to state or
4-21 local systems or both, are authorized to expend a portion
4-22 of the allocated state program funds for such testing
4-23 purposes. Subject to appropriations by the General
4-24 Assembly, the State Board of Education, in addition to the
4-25 assessment program provided for in subsection (a) of this
4-26 Code section, shall provide each local school system funds
4-27 to be used for additional assessment as deemed necessary
4-28 and appropriate by the local school system. The
4-29 additional funds shall be calculated based on the number
4-30 of FTE student counts reported for the preceding school
4-31 year.
4-32 (e) Teachers in grades three through 12 shall participate
4-33 annually in a staff development program on the use of
4-34 tests within the instructional program designed to improve
4-35 students' academic achievement. This program shall
4-36 instruct teachers on curriculum alignment related to
4-37 tests, disaggregated student test data to identify student
4-38 academic weaknesses by subtests, and other appropriate
4-39 applications as determined by the State Board of
4-40 Education."
SECTION 3.
4-41 All laws and parts of laws in conflict with this Act are
4-42 repealed.
