SB 11895 LC 16 3878 SENATE BILL 118 By: Senators Perdue of the 18th, Dean of the 31st, Hill of the 4th and others A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 40-6-391 of the Official Code of 1- 2 Georgia Annotated, relating to driving under the influence 1- 3 of alcohol or drugs, so as to provide for a zero tolerance 1- 4 for drivers under the age of 21; to provide for related 1- 5 matters; to repeal conflicting laws; and for other purposes. 1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 7 Code Section 40-6-391 of the Official Code of Georgia 1- 8 Annotated, relating to driving under the influence of 1- 9 alcohol or drugs, is amended by striking subsection (k) of 1-10 said Code section in its entirety and inserting in lieu 1-11 thereof a new subsection (k) to read as follows: 1-12 "(k) A person under the age of 18 21 shall not drive or be 1-13 in actual physical control of any moving vehicle while the 1-14 person's alcohol concentration is 0.04 0.02 grams or more 1-15 at any time within three hours after such driving or being 1-16 in physical control from alcohol consumed before such 1-17 driving or being in actual physical control ended. Every 1-18 person convicted of violating this subsection shall be 1-19 guilty of a misdemeanor for the first and second 1-20 convictions and upon a third or subsequent conviction 1-21 thereof be guilty of a high and aggravated misdemeanor and 1-22 shall be punished and fined as provided in subsection (c) 1-23 of this Code section. No plea of nolo contendere shall be 1-24 accepted for any person under the age of 18 21 charged 1-25 with a violation of this Code section." SECTION 2. 1-26 All laws and parts of laws in conflict with this Act are 1-27 repealed. S. B. 118 -1- (Index)
