A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 21-5-33 of the Official Code of
1- 2 Georgia Annotated, relating to disposition of campaign
1- 3 contributions, so as to provide that payment for certain
1- 4 services shall not constitute ordinary and necessary
1- 5 expenses for which campaign funds may be expended; to
1- 6 prohibit the use of contributions to a candidate, a campaign
1- 7 committee, or a public officer as payment for such services;
1- 8 to provide for related matters; to repeal conflicting laws;
1- 9 and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-11 Code Section 21-5-33 of the Official Code of Georgia
1-12 Annotated, relating to disposition of campaign
1-13 contributions, is amended by striking in its entirety
1-14 subsection (a) and inserting in lieu thereof the following:
1-15 "(a)(1) Contributions to a candidate, a campaign
1-16 committee, or a public officer holding elective office
1-17 and any proceeds from investing such contributions shall
1-18 be utilized only to defray ordinary and necessary
1-19 expenses, which may include any loan of money from a
1-20 candidate or public officer holding elective office to
1-21 the campaign committee of such candidate or such public
1-22 officer, incurred in connection with such candidate's
1-23 campaign for elective office or such public officer's
1-24 fulfillment or retention of such office.
1-25 (2) For purposes of this subsection, 'ordinary and
1-26 necessary expenses' shall not include any payment for
1-27 campaign consulting services or personal services
1-28 performed by the candidate to any partnership,
1-29 corporation, or other entity which distributes earnings
1-30 or profits to the candidate or public officer. This
1-31 paragraph shall not be construed to prohibit
1-32 reimbursement at a reasonable rate for motor vehicle
1-33 mileage or reimbursement at a reasonable rate for the

2- 1 provision of services performed by others, tangible
2- 2 goods, material, or equipment, so long as such
2- 3 reimbursement is otherwise permissible under paragraph
2- 4 (1) of this subsection."
SECTION 2.
2- 5 All laws and parts of laws in conflict with this Act are
2- 6 repealed.
