SENATE BILL 20

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 20 of the Official Code of
1- 2 Georgia Annotated, relating to elementary, secondary, and
1- 3 adult education, so as to provide that the State School
1- 4 Superintendent shall be authorized to employ and dismiss
1- 5 certain employees of the Department of Education; to provide
1- 6 for other related matters; to provide an effective date; to
1- 7 repeal conflicting laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 9 Chapter 2 of Title 20 of the Official Code of Georgia
1-10 Annotated, relating to elementary, secondary, and adult
1-11 education, is amended by striking Code Section 20-2-11,
1-12 relating to functions of the State Board of Education, and
1-13 inserting in its place a new Code section to read as
1-14 follows:
1-15 "20-2-11. (Index)
1-16 The State Board of Education shall prepare and submit to
1-17 the Governor and General Assembly an estimate of the funds
1-18 necessary for the operation of the state public school
1-19 system. It shall have general supervision of the
1-20 Department of Education and may delegate to subject to the
1-21 exclusive authority of the State School Superintendent the
1-22 authority to employ and dismiss such clerical employees,
1-23 supervisors, administrators, and other employees who are
1-24 members of the classified service under Article 1 of
1-25 Chapter 20 of Title 45 as may be necessary for the
1-26 efficient operation of the Department of Education. It
1-27 shall set aside the necessary funds for the maintenance of
1-28 the office of the department and the State School
1-29 Superintendent, the amount and sufficiency of such funds
1-30 to be in the discretion of the state board, such funds to
1-31 be disbursed by the superintendent in the payment of
1-32 salaries and travel expenses of employees and for

2- 1 printing, communication, equipment, repairs, and other
2- 2 expenses incidental to the operation of the department."
SECTION 2.
2- 3 Said chapter is further amended by striking Code Section
2- 4 20-2-34, relating to functions of the State School
2- 5 Superintendent, and inserting in its place a new Code
2- 6 section to read as follows:
2- 7 "20-2-34. (Index)
2- 8 (a) The State School Superintendent shall carry out and
2- 9 enforce all the rules and regulations of the State Board
2-10 of Education and the laws governing the schools receiving
2-11 state aid.;
2-12 (b) The State School Superintendent shall have the
2-13 authority to employ and dismiss clerical employees,
2-14 supervisors, administrators, and other employees of the
2-15 Department of Education who are members of the classified
2-16 service under Article 1 of Chapter 20 of Title 45 as may
2-17 be necessary for the efficient operation of the Department
2-18 of Education and subject to the availability of funds for
2-19 such employees.
2-20 (c) The State School Superintendent he shall from time to
2-21 time make such recommendations to the state board as may
2-22 affect the welfare and efficiency of the public schools.
2-23 The State School Superintendent He shall have authority to
2-24 suspend a county school superintendent for incompetency,
2-25 willful neglect of duty, misconduct, immorality, or the
2-26 commission of any crime involving moral turpitude,
2-27 provided that all of his or her acts in this matter shall
2-28 be subject to the approval of the state board and the
2-29 party so suspended may appeal his or her case to the state
2-30 board, whose decision shall be final."
SECTION 3.
2-31 This Act shall become effective upon its approval by the
2-32 Governor or upon its becoming effective without such
2-33 approval.
SECTION 4.
2-34 All laws and parts of laws in conflict with this Act are
2-35 repealed.
