A BILL TO BE ENTITLED
AN ACT
1- 1 To amend an Act placing the sheriff and clerk of the
1- 2 Superior Court of Clayton County on an annual salary,
1- 3 approved February 25, 1949 (Ga. L. 1949, p. 1910), as
1- 4 amended, particularly by an Act approved March 28, 1990 (Ga.
1- 5 L. 1990, p. 4623), so as to change the compensation of the
1- 6 deputy clerk of the superior court; to provide for the
1- 7 application of civil service benefits; to provide an
1- 8 effective date; to repeal conflicting laws; and for other
1- 9 purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-11 An Act placing the sheriff and clerk of the Superior Court
1-12 of Clayton County on an annual salary, approved February 25,
1-13 1949 (Ga. L. 1949, p. 1910), as amended, particularly by an
1-14 Act approved March 28, 1990 (Ga. L. 1990, p. 4623), is
1-15 amended by striking Section 1A in its entirety and
1-16 substituting in lieu thereof a new Section 1A to read as
1-17 follows:
"SECTION 1A.
1-18 (a) There is created an office in Clayton County to be
1-19 known as deputy clerk of the superior court, and the clerk
1-20 of the Superior Court of Clayton County is authorized to
1-21 appoint the deputy clerk of the superior court. The
1-22 deputy clerk of the superior court shall serve at the
1-23 pleasure of the clerk of the superior court and may be
1-24 removed from office by the clerk of superior court. The
1-25 deputy clerk of the superior court shall have the same
1-26 authority granted to clerks of superior courts by the laws
1-27 of this state when acting on behalf and at the direction
1-28 of the clerk of Superior Court of Clayton County. The
1-29 qualifications of the deputy clerk of the superior court
1-30 shall be the same as those prescribed for the clerk of the
1-31 superior court, and he or she shall be required to take
1-32 the same oath of office as the clerk of the superior court

2- 1 after appointment and before assuming the duties of
2- 2 office. Except for compensation which shall be as
2- 3 provided in subsection (b) of this section and except for
2- 4 employment and discharge which shall be as provided in
2- 5 this subsection, the deputy clerk of the superior court
2- 6 shall have all benefits afforded to Clayton County
2- 7 employees under the Clayton County Civil Service System
2- 8 Act, approved April 2, 1963 (Ga. L. 1963, p. 2747), as now
2- 9 or hereafter amended.
2-10 (b) The deputy clerk of the superior court shall receive
2-11 as compensation for services a salary to be fixed in the
2-12 discretion of the clerk of the superior court in an amount
2-13 not to exceed $37,800.00 per annum, payable in equal
2-14 monthly installments out of the funds of Clayton County."
SECTION 2.
2-15 This Act shall become effective on July 1, 1995.
SECTION 3.
2-16 All laws and parts of laws in conflict with this Act are
2-17 repealed.
