SB 33995 LC 11 8542/1 SENATE BILL 339 By: Senators Langford of the 29th, Gochenour of the 27th and Madden of the 47th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 37-2-5.1 of the Official Code of 1- 2 Georgia Annotated, relating to allocation of funds by the 1- 3 regional boards, so as to provide for fund allocations to 1- 4 community service boards and procedures regarding bids for 1- 5 services; to provide an effective date; to repeal 1- 6 conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 37-2-5.1 of the Official Code of Georgia 1- 9 Annotated, relating to allocation of funds by the regional 1-10 boards, is amended by adding at the end of subsection (c) 1-11 thereof the following: 1-12 "(4) A regional board shall not reduce the aggregate 1-13 funding for all its community service boards for any 1-14 fiscal year from the level at which all those community 1-15 service boards were funded the immediately preceding 1-16 fiscal year except as follows: 1-17 (A) If the funding from the division to a regional 1-18 board for any fiscal year is reduced from its funding 1-19 the immediately preceding year, the community service 1-20 boards shall receive from the regional board the same 1-21 proportion of those reduced funds which was allocated 1-22 to all the community service boards for the 1-23 immediately preceding fiscal year; 1-24 (B) If the funding is reduced by the same amount by 1-25 which the regional board has contracted with entities, 1-26 other than community service boards, to provide direct 1-27 services, if those contracts are awarded by 1-28 competitive bid of which the community service boards 1-29 and others are notified at least 90 days prior to the 1-30 deadline for submitting the bids in the fiscal year 1-31 beginning July 1, 1995, and at least 180 days prior to 1-32 the deadline for submitting the bids in each fiscal 1-33 year thereafter; or S. B. 339 -1- (Index) LC 11 8542/1 2- 1 (C) As provided in subparagraphs (A) and (B) of this 2- 2 paragraph. 2- 3 (5) If the funding from the division to a regional board 2- 4 for any fiscal year is increased from its funding the 2- 5 immediately preceding year, the community service boards 2- 6 shall receive from the regional board the same 2- 7 proportion of those increased funds which was allocated 2- 8 to all the community service boards for the immediately 2- 9 preceding fiscal year unless the appropriations Act 2-10 increasing such funds specifically provides otherwise or 2-11 unless the regional board contracts to provide services 2-12 under the conditions of subparagraph (B) of paragraph 2-13 (4) of this subsection in the amount of the increase not 2-14 received by the community service boards." SECTION 2. 2-15 This Act shall become effective upon its approval by the 2-16 Governor or upon its becoming law without such approval.
