SB 37795 LC 25 0074 SENATE BILL 377 By: Senators Boshears of the 6th and Kemp of the 3rd A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 6 of Article 1 of Chapter 2 of Title 8 of the 1- 2 Official Code of Georgia Annotated, relating to elevators, 1- 3 dumbwaiters, escalators, manlifts, and moving walks, so as 1- 4 to preclude application of certain laws governing such 1- 5 apparatuses to single-seat, single-passenger chairlifts 1- 6 located in buildings owned and operated by certain nonprofit 1- 7 organizations; to repeal conflicting laws; and for other 1- 8 purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Part 6 of Article 1 of Chapter 2 of Title 8 of the Official 1-11 Code of Georgia Annotated, relating to elevators, 1-12 dumbwaiters, escalators, manlifts, and moving walks, is 1-13 amended by striking in its entirety Code Section 8-2-109.1 1-14 and inserting in its place a new Code Section 8-2-109.1 to 1-15 read as follows: 1-16 "8-2-109.1. (Index) 1-17 (a) This part shall not apply to elevators located on 1-18 vehicles operating under the rules of other state or 1-19 federal authorities and used for carrying passengers or 1-20 freight. 1-21 (b) This part shall not apply to any single-seat, 1-22 single-passenger chairlift located in a building owned and 1-23 operated by an incorporated or unincorporated nonprofit 1-24 organization organized and operated exclusively for 1-25 educational, religious, charitable, or other eleemosynary 1-26 purposes. 1-27 (b)(c) Any county, municipality, or other political 1-28 subdivision which adopts the minimum rules and regulations 1-29 as provided in Code Section 8-2-105 shall be audited on a 1-30 semiannual basis for compliance by the Department of 1-31 Labor; and any laws, ordinances, or resolutions in 1-32 conflict with this part shall be void and of no effect."
