SB 4 95 LC 21 2916 SENATE BILL 4 By: Senator Thomas of the 10th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 10 of Article 8 of Chapter 2 of Title 47 of 1- 2 the Official Code of Georgia Annotated, relating to 1- 3 membership of employees of certain state authorities and 1- 4 commissions in the Employees Retirement System of Georgia, 1- 5 so as to provide that employees of community service boards 1- 6 shall be members of such retirement system; to provide for 1- 7 employee and employer contributions; to provide for 1- 8 creditable service for certain prior service; to provide for 1- 9 an effective date and automatic repeal; to repeal 1-10 conflicting laws; and for other purposes. 1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-12 Part 10 of Article 8 of Chapter 2 of Title 47 of the 1-13 Official Code of Georgia Annotated, relating to membership 1-14 of employees of certain state authorities and commissions in 1-15 the Employees Retirement System of Georgia, is amended by 1-16 inserting at the end thereof the following: 1-17 "47-2-324. (Index) 1-18 As used in this Code section, the term: 1-19 (1) 'Board' means a community service board established 1-20 by Code Section 37-2-6. 1-21 (2) 'Employee' means any full-time employee of a board. 1-22 (3) 'Proof of prior employment' means pay records, 1-23 income tax withholding records, or other records of the 1-24 council which are sufficient to establish to the 1-25 satisfaction of the board of trustees the prior 1-26 employment record of an employee of a board. 1-27 (b) Effective July 1, 1996, or on the date of employment, 1-28 each employee of a board shall become a member of the 1-29 retirement system. 1-30 (c)(1) This subsection shall apply only to an employee 1-31 of a board employed by the board prior to July 1, 1996. B. 4 -1- (Index) LC 21 2916 2- 1 (2) An employee who is subject to the provisions of this 2- 2 subsection shall, upon furnishing proof of prior 2- 3 employment to the board of trustees, be eligible to 2- 4 receive creditable service under this retirement system 2- 5 for prior employment as an employee of a board, subject 2- 6 to the requirements of this subsection. Any such 2- 7 employee must pay to the board of trustees the employer 2- 8 and employee contributions which would have been paid 2- 9 during the period of prior employment if the employee 2-10 had been a member of the retirement system during such 2-11 period. 2-12 (d) Any employee of a board who was already a member of 2-13 the retirement system on July 1, 1996, and any member of 2-14 the retirement system who, without any break in service, 2-15 becomes an employee of a board on or after July 1, 1996, 2-16 shall continue in the same membership status without any 2-17 interruption in membership service and without the loss of 2-18 any creditable service. 2-19 (e) Except as otherwise provided in subsection (d) of this 2-20 Code section, an employee of a board becoming a member of 2-21 the retirement system pursuant to the provisions of this 2-22 Code section shall be subject to the provisions of Code 2-23 Section 47-2-334. 2-24 (f) All employer contributions which are required by this 2-25 chapter shall be made for members who are subject to the 2-26 provisions of this Code section from funds appropriated to 2-27 or otherwise available for the operation of the community 2-28 service boards. The boards shall deduct from the salaries 2-29 payable to such members the additional employee 2-30 contributions required by this chapter." SECTION 2. 2-31 This Act shall become effective on July 1, 1996, only if it 2-32 is determined to have been concurrently funded as provided 2-33 in Chapter 20 of Title 47 of the Official Code of Georgia 2-34 Annotated, the "Public Retirement Systems Standards Law"; 2-35 otherwise, this Act shall not become effective and shall be 2-36 automatically repealed in its entirety on July 1, 1996, as 2-37 required by subsection (a) of Code Section 47-20-50.
