SB 45 95 LC 21 2930 SENATE BILL 45 By: Senators Crotts of the 17th, Isakson of the 21st, Pollard of the 24th and Starr of the 44th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 33-23-1 of the Official Code of 1- 2 Georgia Annotated, relating to definitions relative to 1- 3 insurance agents, subagents, counselors, and adjusters, so 1- 4 as to provide that a regular salaried officer or employee of 1- 5 an insurer or of an agent or subagent who performs only 1- 6 clerical or administrative services in connection with any 1- 7 insurance transaction and who is not involved in soliciting 1- 8 insurance or signing or countersigning contracts shall not 1- 9 be considered an agent, subagent, counselor, or adjuster; to 1-10 provide for an effective date; to repeal conflicting laws; 1-11 and for other purposes. 1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Code Section 33-23-1 of the Official Code of Georgia 1-14 Annotated, relating to definitions relative to insurance 1-15 agents, subagents, counselors, and adjusters, is amended by 1-16 striking in its entirety paragraph (1) of subsection (b) and 1-17 inserting in lieu thereof the following: 1-18 "(1) Any regular salaried officer or employee of an 1-19 insurer or of an agent or subagent who performs only 1-20 clerical or administrative services in connection with 1-21 any insurance transaction so long as such person is not 1-22 involved in soliciting insurance, or signing or 1-23 countersigning contracts, or receiving premiums;" SECTION 2. 1-24 This Act shall become effective upon its approval by the 1-25 Governor or upon its becoming law without such approval. SECTION 3. 1-26 All laws and parts of laws in conflict with this Act are 1-27 repealed. S. B. 45 -1- (Index)
