A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 6 of Chapter 2 of Title 20 of the Official
1- 2 Code of Georgia Annotated, the "Quality Basic Education
1- 3 Act," so as to change the provisions relating to migrant
1- 4 student grants; to change the definitions relating to
1- 5 educational capital funding; to change the provisions
1- 6 relating to additional funding for school systems having
1- 7 exceptional growth; to amend Code Section 50-27-3 of the
1- 8 Official Code of Georgia Annotated, relating to definitions
1- 9 applicable to the "Georgia Lottery for Education Act," so as
1-10 to change the definition of the term "educational purposes
1-11 and programs"; to authorize appropriations from the Lottery
1-12 for Education Account for the purpose of providing teachers
1-13 at accredited public institutions who teach levels K-12,
1-14 teachers and personnel at public postsecondary technical
1-15 institutes under the authority of the Department of
1-16 Technical and Adult Education, and professors and
1-17 instructors within the University System of Georgia the

1-19 and advanced electronic instruction of computers and
1-20 advanced electronic instructional technology to implement
1-21 interactive learning environments in the classroom and to
1-22 access the state-wide distance learning network; to
1-23 authorize appropriations from the Lottery for Education
1-24 Account for costs associated with repairing and maintaining
1-25 advanced electronic instructional technology; to amend Code
1-26 Section 20-2-252 of the Official Code of Georgia Annotated,
1-27 relating to electronic technology, so as to provide that the
1-28 State Board of Education shall prescribe criteria, policies,
1-29 and standards deemed necessary for the effective
1-30 implementation of a program financed wholly or partially
1-31 from appropriations from the Lottery for Education Account
1-32 and established for the purpose of providing teachers the
1-33 necessary training in the use and application of computers
1-34 and advanced electronic instructional technology to
1-35 implement interactive learning environments in the classroom
1-36 and to access the state-wide distance learning network and
1-37 for other purposes; to amend Part 2 of Article 2 of Chapter

2- 1 3 of Title 20 of the Official Code of Georgia Annotated,
2- 2 relating to the University System of Georgia, so as to
2- 3 provide that the Board of Regents of the University System
2- 4 of Georgia shall prescribe criteria, policies, and standards
2- 5 deemed necessary for the effective implementation of
2- 6 programs within the university system financed wholly or
2- 7 partially from appropriations from the Lottery for Education
2- 8 Account and established for the purpose of providing
2- 9 professors and instructors the necessary training in the use
2-10 and application of computers and advanced electronic
2-11 instructional technology to implement interactive learning
2-12 environments in the classroom and to access the state-wide
2-13 distance learning network and for other purposes; to amend
2-14 Code Section 20-4-11 of the Official Code of Georgia
2-15 Annotated, relating to the powers of the State Board of
2-16 Technical and Adult Education, so as to provide that the
2-17 State Board of Technical and Adult Education shall prescribe
2-18 criteria, policies, and standards deemed necessary for the
2-19 effective implementation of a program financed wholly or
2-20 partially from appropriations from the Lottery for Education
2-21 Account and established for the purpose of providing
2-22 personnel at public postsecondary technical institutes
2-23 necessary training in the use and application of computers
2-24 and advanced electronic instructional technology to
2-25 implement interactive learning environments in the classroom
2-26 and to access the state-wide distance learning network and
2-27 for other purposes; to provide an effective date; to repeal
2-28 conflicting laws; and for other purposes.
2-29 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
2-30 Article 6 of Chapter 2 of Title 20 of the Official Code of
2-31 Georgia Annotated, the "Quality Basic Education Act," is
2-32 amended by striking subsections (b) and (c) of Code Section
2-33 20-2-189, relating to migrant student grants, and inserting
2-34 in its place the following:
2-35 "(b) The State Board of Education shall provide grants to
2-36 qualified local units of administration for the purpose of
2-37 supplementing services and instruction to currently
2-38 enrolled migrant students. A local unit of administration
2-39 shall not be eligible for such grant for any school
2-40 thereof unless the number of migrant students enrolled in
2-41 such school is at least 20 or equals at least 5 percent of
2-42 the latest full-time equivalent program count for such

3- 1 school, whichever is greater. The State Department of
3- 2 Education by regulation shall establish the manner in
3- 3 which a local unit of administration must demonstrate that
20-3-77.1 N ts schools meets the eligibility requirements of
3- 5 this subsection.
3- 6 (c) Grants under this Code section shall be subject to
3- 7 appropriation by the General Assembly. The grant amount
3- 8 for a local unit of administration to be used for a school
3- 9 thereof under this Code section shall be determined by
3-10 multiplying the total appropriation for such grants by a
3-11 fraction, the numerator of which is the average number of
3-12 eligible migrant students enrolling in that school after
3-13 the final FTE count as required in subsection (a) of Code
3-14 Section 20-2-160 but prior to the end of the same academic
3-15 year and the denominator of which is the average total
3-16 number of eligible migrant students enrolling after the
3-17 final FTE count as required in subsection (a) of Code
3-18 Section 20-2-160 but prior to the end of the same academic
3-19 year in all local units in the entire state. At least 90
3-20 percent of the grant funds received by a local unit under
3-21 this Code section shall be used for direct program
3-22 expenditures at the school for which the grant is computed
3-23 under this subsection. Any portion of that 90 percent not
3-24 so expended shall be returned to the State Department of
3-25 Education."
SECTION 2.
3-26 Said article is further amended by striking paragraph (7.1)
3-27 of subsection (b) of Code Section 20-2-260, relating to
3-28 educational capital funding, and inserting in its place the
3-29 following:
3-30 "(7.1) 'Exceptional growth' means an increase in the
3-31 average of a local school system's average full-time
3-32 equivalent student count for the three most recently
3-33 completed school years when compared to the average of
3-34 that system's average full-time equivalent count for the
3-35 three most recently completed school years prior to the
3-36 most recently completed school year that growth
3-37 experienced by an exceptional growth system under the
3-38 calculations specified in subparagraph (j)(2)(A) of this
3-39 Code section."

SECTION 3.
4- 1 Said Code section is further amended by striking
4- 2 subparagraph (j)(2)(A) thereof and inserting in its place
4- 3 the following:
4- 4 "(A) The average of each school system's average
4- 5 full-time equivalent count for the three most recently
4- 6 completed school years ('most recent average') will be
4- 7 compared to the average of that system's average
4- 8 full-time equivalent count for the three most recently
4- 9 completed school years prior to the most recently
4-10 completed school year ('earlier average'). If there is
4-11 an increase in a school system's most recent average
4-12 of at least 1.5 percent and at least 65 average
4-13 full-time equivalent counts over that system's earlier
4-14 average, that system will be an exceptional growth
4-15 system. For each such exceptional growth school system
4-16 with an increased average count of at least 65 average
4-17 full-time equivalent counts after the above
4-18 calculation, the amount of such increase will be
4-19 divided by the total such increase for all school
4-20 exceptional growth systems with an increased average
4-21 count under this subsection to provide the ratio of
4-22 each system's growth to the total growth of all
4-23 systems with exceptional growth; and".
SECTION 4.
4-24 Said Code section is further amended by striking
4-25 subparagraph (j)(6)(B) thereof and inserting in its place
4-26 the following:
4-27 "(B) Any construction project submitted to utilize
4-28 growth entitlement shall include construction of at
4-29 least one three new instructional unit units. If
4-30 sufficient growth entitlement is not currently
4-31 available for all of the new instructional units
4-32 needed under this subsection, additional local funds
4-33 or entitlements available to meet construction needs
4-34 identified in the school system's facilities plan
4-35 pursuant to subsection (g) of this Code section may be
4-36 combined with any entitlement available for
4-37 exceptional growth pursuant to this subsection for the
4-38 purpose of completing all construction needs
4-39 identified at a school. Entitlements earned under
4-40 this subsection shall not be withheld, recalculated,
4-41 or otherwise reduced for any construction project

5- 1 approved under subsection (g) of this Code section.
5- 2 Exceptional growth entitlement shall be utilized for
5- 3 construction of new instructional units at an existing
5- 4 school or for new schools only for those schools
5- 5 which, following the completion of such construction,
5- 6 meet the minimum size specified in subsection (q) of
5- 7 this Code section. Other funding sources must be
5- 8 utilized for any renovation or modification activities
5- 9 which may be needed; and".
SECTION 5.
5-10 Code Section 50-27-3 of the Official Code of Georgia
5-11 Annotated, relating to definitions applicable to the
5-12 "Georgia Lottery for Education Act," is amended by striking
5-13 paragraph (8) in its entirety and inserting in lieu thereof
5-14 a new paragraph (8) to read as follows:
5-15 "(8) 'Educational purposes and programs' means capital
5-16 outlay projects for educational facilities; tuition
5-17 grants, scholarships, or loans to citizens of this state
5-18 to enable such citizens to attend colleges and
5-19 universities located within this state, regardless of
5-20 whether such colleges and universities are owned or
5-21 operated by the board of regents or to attend
5-22 institutions operated under the authority of the
5-23 Department of Technical and Adult Education; costs of
5-24 providing to teachers at accredited public institutions
5-25 who teach levels K-12, personnel at public postsecondary
5-26 technical institutes under the authority of the
5-27 Department of Technical and Adult Education, and
5-28 professors and instructors within the University System
5-29 of Georgia the necessary training in the use and
5-30 application of computers and advanced electronic
5-31 instructional technology to implement interactive
5-32 learning environments in the classroom and to access the
5-33 state-wide distance learning network; costs associated
5-34 with repairing and maintaining advanced electronic
5-35 instructional technology; voluntary pre-kindergarten;
5-36 and an education shortfall reserve."
SECTION 6.
5-37 Code Section 20-2-252 of the Official Code of Georgia
5-38 Annotated, relating to electronic technology, is amended by
5-39 adding at the end thereof a new subsection (e) to read as
5-40 follows:

6- 1 "(e) The State Board of Education shall prescribe
6- 2 criteria, policies, and standards deemed necessary for the
6- 3 effective implementation of a program financed wholly or
6- 4 partially from appropriations from the Lottery for
6- 5 Education Account and established for the purpose of
6- 6 providing teachers the necessary training in the use and
6- 7 application of computers and advanced electronic
6- 8 instructional technology to implement interactive learning
6- 9 environments in the classroom and to access the state-wide
6-10 distance learning network. The State Board of Education
6-11 shall expend funds appropriated for such purpose to defray
6-12 the costs associated with repairing and maintaining
6-13 advanced electronic instructional technology."
SECTION 7.
6-14 Part 2 of Article 2 of Chapter 3 of Title 20 of the Official
6-15 Code of Georgia Annotated, relating to the University System
6-16 of Georgia, is amended by adding between Code Section
6-17 20-3-77 and 20-3-78 a new Code Section 20-3-77.1 to read as
6-18 follows:
6-19 "20-3-77.1. (Index)
6-20 The board of regents shall prescribe criteria, policies,
6-21 and standards deemed necessary for the effective
6-22 implementation of programs within the university system
6-23 financed wholly or partially from appropriations from the
6-24 Lottery for Education Account and established for the
6-25 purpose of providing professors and instructors the
6-26 necessary training in the use and application of computers
6-27 and advanced electronic instructional technology to
6-28 implement interactive learning environments in the
6-29 classroom and to access the state-wide distance learning
6-30 network. Such programs shall include the expenditure of
6-31 funds to defray the costs associated with repairing and
6-32 maintaining advanced electronic instructional technology."
SECTION 8.
6-33 Code Section 20-4-11 of the Official Code of Georgia
6-34 Annotated, relating to the powers of the State Board of
6-35 Technical and Adult Education, is amended by striking the
6-36 word "and" from the end of paragraph (7), by striking the
6-37 period at the end of paragraph (8) and inserting in lieu
6-38 thereof the following: "; and", and by adding at the end
6-39 thereof a new paragraph (9) to read as follows:

7- 1 "(9) Prescribe criteria, policies, and standards deemed
7- 2 necessary for the effective implementation of a program
7- 3 financed wholly or partially from appropriations from
7- 4 the Lottery for Education Account and established for
7- 5 the purpose of providing teachers the necessary training
7- 6 in the use and application of computers and advanced
7- 7 electronic instructional technology to implement
7- 8 interactive learning environments in the classroom and
7- 9 to access the state-wide distance learning network.
7-10 Such program shall include the expenditure of funds
7-11 appropriated for such purpose to defray the costs
7-12 associated with repairing and maintaining advanced
7-13 electronic instructional technology."
SECTION 9.
7-14 This Act shall become effective upon its approval by the
7-15 Governor or upon its becoming law without such approval.
SECTION 10.
7-16 All laws and parts of laws in conflict with this Act are
7-17 repealed.
