SB 509 96 LC 24 0245 SENATE BILL 509 By: Senator Cheeks of the 23rd A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 1 of Chapter 12 of Title 16 of the Official 1- 2 Code of Georgia Annotated, relating to general provisions of 1- 3 offenses against public health and morals, so as to prohibit 1- 4 the sale to minors of objects which look like syringes or 1- 5 other drug paraphernalia; to provide for related matters; to 1- 6 repeal conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Article 1 of Chapter 12 of Title 16 of the Official Code of 1- 9 Georgia Annotated, relating to general provisions of 1-10 offenses against public health and morals, is amended by 1-11 adding a new Code section at the end thereof to read as 1-12 follows: 1-13 "16-12-6. (Index) 1-14 (a) It shall be unlawful for any person knowingly to sell 1-15 to minors, directly or indirectly, any object which is 1-16 packaged and marketed as candy, a toy, a novelty item, or 1-17 a writing utensil which object looks like a syringe or 1-18 other drug paraphernalia. 1-19 (b) Any person who violates subsection (a) of this Code 1-20 section shall be guilty of a misdemeanor." SECTION 2. 1-21 All laws and parts of laws in conflict with this Act are 1-22 repealed. S. B. 509 -1- (Index)
