SENATE BILL 52

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 19 of Chapter 2 of Title 20 of the Official
1- 2 Code of Georgia Annotated, relating to public school
1- 3 textbooks, so as to change the manner in which such
1- 4 textbooks are approved and selected; to provide for
1- 5 compliance with other rules; to provide for an effective
1- 6 date; to repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Article 19 of Chapter 2 of Title 20 of the Official Code of
1- 9 Georgia Annotated, relating to public school textbooks, is
1-10 amended by striking Code Section 20-2-1012, relating to
1-11 committees to recommend textbooks, and inserting in its
1-12 place the following:
1-13 "20-2-1012. (Index)
1-14 (a) The State Board of Education shall select a committee
1-15 or committees of educators actually engaged in public
1-16 school work in this state to examine textbooks and make
1-17 recommendations thereon to the state board. Such
1-18 committee or committees shall consist of such number of
1-19 educators as the state board may deem advisable, not
1-20 exceeding five in each instance. They shall serve for
1-21 such time and for such duties as the state board may
1-22 prescribe and shall receive such compensation as may be
1-23 fixed by the state board.
1-24 (b) In addition to any other method of textbook selection,
1-25 the State Board of Education shall add to the approved
1-26 list of textbooks for use in the public schools of this
1-27 state any textbook or series of textbooks requested in
1-28 writing by:
1-29 (1) The superintendents of five or more different school
1-30 systems; or

2- 1 (2) Twenty or more teachers from at least 20 different
2- 2 school systems who teach and are certified to teach the
2- 3 courses encompassed by the textbook requested,
2- 4 if the requisite number of requests for the specified
2- 5 textbook are received within any 365 day period. A
2- 6 textbook so required to be added to the approved list
2- 7 shall be added within 30 days following the receipt by the
2- 8 state board of the requisite number of requests. No
2- 9 designation shall be included upon the approved list which
2-10 indicates the manner in which any textbook was added to
2-11 the list. Other than the selection method, publishers
2-12 whose textbooks are added to the approved list as provided
2-13 in this subsection shall be required to comply with the
2-14 same rules regarding textbooks as other publishers,
2-15 including but not limited to price, durability, and
2-16 availability."
SECTION 2.
2-17 This Act shall become effective upon its approval by the
2-18 Governor or upon its becoming law without such approval.
SECTION 3.
2-19 All laws and parts of laws in conflict with this Act are
2-20 repealed.
