SB 539 96 SB539/AP SENATE BILL 539 By: Senators Starr of the 44th, Perdue of the 18th and Oliver of the 42nd A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 1 of Chapter 11 of Title 15 of the Official 1- 2 Code of Georgia Annotated, relating to juvenile proceedings, 1- 3 so as to provide for the use of certain juvenile court 1- 4 records; to repeal conflicting laws; and for other purposes. 1- 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 6 Article 1 of Chapter 11 of Title 15 of the Official Code of 1- 7 Georgia Annotated, relating to juvenile proceedings, is 1- 8 amended by striking in its entirety subsection (b) of Code 1- 9 Section 15-11-38, relating to the nature and effect of 1-10 adjudication in juvenile courts, and inserting in lieu 1-11 thereof the following: 1-12 "(b) The disposition of a child and evidence adduced in a 1-13 hearing in the juvenile court may not be used against him 1-14 such child in any proceeding in any court other than for a 1-15 proceeding for delinquency or unruliness, whether before 1-16 or after reaching majority, except in dispositional 1-17 proceedings after conviction of a felony for the purposes 1-18 of a presentence investigation and report the 1-19 establishment of conditions of bail, plea negotiations, 1-20 and sentencing in felony offenses." SECTION 2. 1-21 All laws and parts of laws in conflict with this Act are 1-22 repealed. S. B. 539 -1- (Index)
