SB 569 96 LC 21 3702 SENATE BILL 569 By: Senator Boshears of the 6th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 36-30-7.1 of the Official Code of 1- 2 Georgia Annotated, relating to inactive municipalities, so 1- 3 as to provide that a new charter may be granted to a 1- 4 municipal corporation which ceased to exist because of the 1- 5 provisions of such Code section; to provide an effective 1- 6 date; to repeal conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 36-30-7.1 of the Official Code of Georgia 1- 9 Annotated, relating to inactive municipalities, is amended 1-10 by striking in its entirety subsection (i) and inserting in 1-11 lieu thereof the following: 1-12 "(i) At the session of the General Assembly held in the 1-13 year 1996 only, a A new charter may be granted to a 1-14 municipal corporation which ceased to exist under the 1-15 provisions of this Code section solely because of a 1-16 failure to make the required filing with the Department of 1-17 Community Affairs (not including any case where the 1-18 municipal corporation failed or for failure to meet the 1-19 minimum standards of an active municipality enumerated in 1-20 subsection (b) of this Code section), without regard to 1-21 the minimum standards for incorporation set out in Chapter 1-22 31 of this title. In such a case the local law granting 1-23 the new charter shall have attached thereto, in lieu of 1-24 the certificate otherwise required by Code Section 1-25 36-31-5, a certificate by the author of the bill stating 1-26 that the requirements of this subsection are met by the 1-27 municipal corporation being reincorporated. In any such 1-28 case assets and property and rights and obligations which 1-29 devolved upon the county shall be retransferred from the 1-30 county back to the municipal corporation." Section 2. 1-31 This Act shall become effective upon its approval by the 1-32 Governor or upon its becoming law without such approval. S.
