A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 6 of Title 16 of the Official Code of
1- 2 Georgia Annotated, relating to sexual offenses, so as to
1- 3 change the definitions of the offenses of statutory rape,
1- 4 child molestation, and enticing a child for indecent
1- 5 purposes; to provide for related matters; to repeal
1- 6 conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Chapter 6 of Title 16 of the Official Code of Georgia
1- 9 Annotated, relating to sexual offenses, is amended by
1-10 striking in its entirety subsection (a) of Code Section
1-11 16-6-3, relating to the offense of statutory rape, and
1-12 inserting in lieu thereof a new subsection to read as
1-13 follows:
1-14 "(a) A person commits the offense of statutory rape when
1-15 he or she engages in consensual sexual intercourse with
1-16 any female person under the age of 14 16 years and not his
1-17 or her spouse, provided that no conviction shall be had
1-18 for this offense on the unsupported testimony of the
1-19 female victim."
SECTION 2.
1-20 Said chapter is further amended by striking in its entirety
1-21 subsection (a) of Code Section 16-6-4, relating to the
1-22 offense of child molestation, and inserting in lieu thereof
1-23 a new subsection to read as follows:
1-24 "(a) A person commits the offense of child molestation
1-25 when he or she does any immoral or indecent act to or in
1-26 the presence of or with any child under the age of 14 16
1-27 years with the intent to arouse or satisfy the sexual
1-28 desires of either the child or the person."

SECTION 3.
2- 1 Said chapter is further amended by striking in its entirety
2- 2 subsection (a) of Code Section 16-6-5, relating to the
2- 3 offense of enticing a child for indecent purposes, and
2- 4 inserting in lieu thereof a new subsection to read as
2- 5 follows:
2- 6 "(a) A person commits the offense of enticing a child for
2- 7 indecent purposes when he or she solicits, entices, or
2- 8 takes any child under the age of 14 16 years to any place
2- 9 whatsoever for the purpose of child molestation or
2-10 indecent acts."
SECTION 4.
2-11 All laws and parts of laws in conflict with this Act are
2-12 repealed.
