substitute to SB 578:
A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 9 of Title 16 of the Official
1- 2 Code of Georgia Annotated, relating to forgery and related
1- 3 offenses, so as to change the penalty for sale or
1- 4 distribution of a false identification document; to provide
1- 5 for related matters; to provide an effective date; to
1- 6 provide for applicability; to repeal conflicting laws; and
1- 7 for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 9 Article 1 of Chapter 9 of Title 16 of the Official Code of
1-10 Georgia Annotated, relating to forgery and related offenses,
1-11 is amended by striking in its entirety Code Section 16-9-4,
1-12 relating to identification documents, and inserting in lieu
1-13 thereof the following:
1-14 "16-9-4. (Index)
1-15 (a) As used in this Code section, the term 'identification
1-16 document' means any document issued by a government agency
1-17 containing a description of the person or such person's
1-18 photograph, or both, and giving such person's date of
1-19 birth, and includes without being limited to a passport,
1-20 military identification card, or driver's license, or an
1-21 identification card authorized under Code Sections
1-22 40-5-100 through 40-5-104.
1-23 (b)(1) It shall be unlawful for any person to knowingly
1-24 manufacture, sell, or distribute a false identification
1-25 document.
1-26 (2) Except as provided in subsection (c) of this Code
1-27 section, any Any person who violates paragraph (1) of
1-28 this subsection on the first offense shall be guilty of
1-29 a misdemeanor. Any person who violates paragraph (1) of
1-30 this subsection for the second or any subsequent offense
1-31 shall be guilty of a felony and shall be punished by a

2- 1 fine of not more than $5,000.00 or by imprisonment for
2- 2 not more than three years, or both.
2- 3 (c) Any person who knowingly manufactures, sells or
2- 4 distributes a false identification document in exchange
2- 5 for consideration shall be guilty of a felony and shall be
2- 6 punished by a fine of not more than $3,000.00 or by
2- 7 imprisonment for not more than three years, or both."
SECTION 2.
2- 8 This Act shall become effective on July 1, 1996, and shall
2- 9 apply to conduct committed on or after July 1, 1996.
SECTION 3.
2-10 All laws and parts of laws in conflict with this Act are
2-11 repealed.
