SB 61 95 LC 22 1340 SENATE BILL 61 By: Senator Ragan of the 11th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 6 of Title 19 of the Official Code of 1- 2 Georgia Annotated, relating to alimony and child support, so 1- 3 as to provide for the appointment of counsel in certain 1- 4 contempt proceedings for failure to pay child support; to 1- 5 provide for eligibility; to provide for related matters; to 1- 6 repeal conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Chapter 6 of Title 19 of the Official Code of Georgia 1- 9 Annotated, relating to alimony and child support, is amended 1-10 by inserting a new Code section to be designated Code 1-11 Section 19-6-34, to read as follows: 1-12 "19-6-34. (Index) 1-13 When a civil contempt proceeding for failure to pay child 1-14 support is filed by an attorney as a part of such 1-15 attorney's official duties as an employee or contractor of 1-16 the state, an agency or instrumentality of the state, or a 1-17 political subdivision of the state, an indigent defendant 1-18 in such a proceeding shall be entitled to legal 1-19 representation by appointed or assigned counsel or by the 1-20 public defender in accordance with the provisions of 1-21 Articles 1, 2, and 4 of Chapter 12 of Title 17. Indigence 1-22 and eligibility for counsel shall be determined in 1-23 accordance with the provisions of Articles 1, 2, and 4 of 1-24 Chapter 12 of Title 17."
