SB 619 96 LC 22 1964 SENATE BILL 619 By: Senators Clay of the 37th and Ralston of the 51st A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 15-11-90 of the Official Code of 1- 2 Georgia Annotated, relating to placement of a child after 1- 3 termination of parental rights, so as to provide that 1- 4 placement with a member of the child's extended family or 1- 5 with a person related to the child shall be made only if 1- 6 such a placement is in the best interest of the child; to 1- 7 provide for related matters; to repeal conflicting laws; and 1- 8 for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Code Section 15-11-90 of the Official Code of Georgia 1-11 Annotated, relating to placement of a child after 1-12 termination of parental rights, is amended by striking in 1-13 its entirety paragraph (1) of subsection (a) and inserting 1-14 in lieu thereof the following: 1-15 "(a)(1) If, upon the entering of an order terminating 1-16 the parental rights of a parent, there is no parent 1-17 having parental rights, the court shall first attempt to 1-18 place the child with the child's extended family or with 1-19 a person related to the child by blood or marriage. An 1-20 exhaustive and thorough search for a suitable family 1-21 member shall be made by the court and the Department of 1-22 Human Resources in attempting to effect this placement. 1-23 A placement effected under this paragraph shall be 1-24 conditioned upon the family member who is given 1-25 permanent custody or who is granted an adoption of the 1-26 child agreeing to abide by the terms and conditions of 1-27 the order of the court. A placement shall be made under 1-28 the terms of this paragraph only if such a placement is 1-29 in the best interest of the child." SECTION 2. 1-30 All laws and parts of laws in conflict with this Act are 1-31 repealed. S. B. 619 -1- (Index)
