SB 67 96 SB67/AP SENATE BILL 67 By: Senator Farrow of the 54th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 47-13-72 of the Official Code of 1- 2 Georgia Annotated, relating to spouses' benefit coverage 1- 3 under the District Attorneys' Retirement System, so as to 1- 4 provide that members of such retirement system may elect 1- 5 such benefits for a spouse who became a spouse while such 1- 6 member was a member by making such election prior to 1- 7 December 31, 1996, or six months subsequent to such 1- 8 marriage, whichever date is later; to provide for related 1- 9 matters; to provide for an effective date and automatic 1-10 repeal; to repeal conflicting laws; and for other purposes. 1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-12 Code Section 47-13-72 of the Official Code of Georgia 1-13 Annotated, relating to spouses' benefit coverage under the 1-14 District Attorneys' Retirement System, is amended by 1-15 striking in its entirety subsection (e) and inserting in 1-16 lieu thereof the following: 1-17 "(e) Any member of the retirement system who rejects 1-18 spouses' benefits coverage or who ceases such coverage 1-19 pursuant to subsection (f) of this Code section because 1-20 such member was unmarried at the time of such rejection or 1-21 because such member's spouse died or because such member 1-22 ceased to be married shall have the option to elect 1-23 spouses' benefits prior to December 31, 1996, or within 60 1-24 days six months after becoming married or remarried, as 1-25 the case may be, whichever date is later. The member 1-26 shall, at the time of making the election, pay to the 1-27 board of trustees the total amount of contributions which 1-28 would have been made from the month of the marriage or 1-29 remarriage to the date of the election. Any member so 1-30 electing must make the necessary contributions for 1-31 spouses' benefits coverage for a total of at least ten 1-32 years, including any period for which retroactive payments 1-33 are made, in order for such member's spouse to qualify for 1-34 the spouses' benefits provided for by this Code section." B. 67 -1- (Index) SB67/AP SECTION 2. 2- 1 This Act shall become effective on July 1, 1996, only if it 2- 2 is determined to have been concurrently funded as provided 2- 3 in Chapter 20 of Title 47 of the Official Code of Georgia 2- 4 Annotated, the "Public Retirement Systems Standards Law"; 2- 5 otherwise, this Act shall not become effective and shall be 2- 6 automatically repealed in its entirety on July 1, 1996, as 2- 7 required by subsection (a) of Code Section 47-20-50.
