SB 68 LC 19 2609S _________________________ offers the following substitute to SB 68: A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 20-2-142 of the Official Code of 1- 2 Georgia Annotated, relating to prescribed courses relating 1- 3 to the development and dissemination of instructional 1- 4 materials on the effect of alcohol, so as to provide for a 1- 5 course of study in home economics which includes parenting 1- 6 education as prescribed by the Department of Education for 1- 7 all state funded schools with grades seven or eight; to 1- 8 provide for related matters; to repeal conflicting laws; and 1- 9 for other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Code Section 20-2-142 of the Official Code of Georgia 1-12 Annotated, relating to prescribed courses relating to the 1-13 development and dissemination of instructional materials on 1-14 the effect of alcohol, is amended by striking said Code 1-15 section in its entirety and inserting in lieu thereof a new 1-16 Code Section 20-2-142 to read as follows: 1-17 "20-2-142. (Index) 1-18 (a)(1) All elementary and secondary schools which 1-19 receive in any manner funds from the state shall provide 1-20 the following course offerings in the manner prescribed 1-21 by the State Board of Education: 1-22 (A) A course of study in the background, history, and 1-23 development of the federal and state governments. The 1-24 course in the study of federal and state governments 1-25 shall be supplemented in each high school by a study 1-26 of the local county and municipal governments; and 1-27 (B) A course of study in the history of the United 1-28 States and in the history of Georgia and in the 1-29 essentials of the United States and Georgia 1-30 Constitutions, including the study of American 1-31 institutions and ideals. -1- (Index) LC 19 2609S 2- 1 (2) No student shall be eligible to receive a diploma 2- 2 from a high school unless such student has successfully 2- 3 completed the courses in history and government provided 2- 4 for by this subsection, except as provided in paragraph 2- 5 (3) of this subsection. 2- 6 (3) Handicapped students who are otherwise eligible for 2- 7 a special education diploma pursuant to subsection (c) 2- 8 of Code Section 20-2-281 shall not be denied this 2- 9 diploma if they have not successfully completed either 2-10 or both of these courses; provided, however, that their 2-11 Individualized Education Programs have not specified 2-12 that the handicapped students must enroll in and 2-13 successfully complete both of these courses. 2-14 (b)(1) The State Board of Education and the Board of 2-15 Public Safety shall jointly establish an alcohol and 2-16 drug course for the purpose of informing the young 2-17 people of this state of the dangers involved in 2-18 consuming alcohol or certain drugs in connection with 2-19 the operation of a motor vehicle. The course shall be 2-20 designed to generate greater interest in highway safety 2-21 and accident prevention. The state board and the Board 2-22 of Public Safety shall jointly, by rules or regulations, 2-23 determine the contents of the course and its duration. 2-24 The Board of Public Safety shall make available officers 2-25 or employees of the Department of Public Safety to teach 2-26 the alcohol and drug course. The alcohol and drug 2-27 course shall be offered periodically but not less than 2-28 once annually in the public schools of this state to 2-29 students in grades nine and above in the manner 2-30 prescribed by the state board. 2-31 (2) All schools with grade nine or above which receive 2-32 funds in any manner from the state shall make available 2-33 to eligible students the alcohol and drug course 2-34 provided in paragraph (1) of this subsection. 2-35 (3) The commissioner of public safety shall make the 2-36 alcohol and drug course, and instructors where 2-37 necessary, available to the private schools in this 2-38 state. In addition, the commissioner of public safety 2-39 shall offer the alcohol and drug course periodically at 2-40 various locations in the state in the manner provided by 2-41 the Board of Public Safety. 2-42 (c) The State Board of Education shall prescribe a course 2-43 of study in health and physical education for all grades -2- (Index) LC 19 2609S 3- 1 and grade levels in the public schools and shall establish 3- 2 standards for its administration. The course shall 3- 3 include instruction concerning the impact of alcohol, 3- 4 tobacco, and drug use upon health and may occupy periods 3- 5 totaling not less than 30 minutes per day in kindergarten 3- 6 through grade eight or equivalent grade levels. A manual 3- 7 setting out the details of such courses of study shall be 3- 8 prepared or approved by the State School Superintendent in 3- 9 cooperation with the Department of Human Resources, the 3-10 state board, and such expert advisers as they may choose. 3-11 The Department of Education is directed to assemble or 3-12 develop instructional resources and materials concerning 3-13 alcohol and drug abuse, taking into consideration 3-14 technological enhancements available for utilization of 3-15 such instructional resources. 3-16 (d)(1) All schools with grades seven or eight which 3-17 receive in any manner funds from the state may provide a 3-18 course of study in home economics to include parenting 3-19 education. 3-20 (2) The Department of Education shall prescribe a course 3-21 of home economics to include a unit on parenting 3-22 education. This unit shall contain but not be limited 3-23 to instruction to prepare students to understand 3-24 children's physical, mental, emotional, and social 3-25 growth and development with emphasis on nutrition, 3-26 family living and community relationships, domestic 3-27 violence, home management, and the responsibilities of 3-28 parenthood. The unit shall not contain any materials 3-29 that would define emotional, social, political, or 3-30 religious values. 3-31 (3) All parenting education instruction shall be taught 3-32 by a certified teacher. All instruction shall be in 3-33 accordance with Georgia law. 3-34 (d)(e) The funds allocated under Code Section 20-2-13 3-35 shall be used for the purpose of creating and maintaining 3-36 state educational research services for purposes which 3-37 shall include, but shall not be limited to, the following: 3-38 (1) For the development, production, and procurement of 3-39 curriculum materials and units of instruction on the 3-40 scientific facts in regard to the influence and effect 3-41 of alcohol on human health and behavior and on social 3-42 and economic conditions, including suggested methods of 3-43 instruction in ways of working with boys and girls and -3- (Index) LC 19 2609S 4- 1 young people in the various age groups and grade levels 4- 2 of the public schools of the state, as aids to classroom 4- 3 teachers and others responsible for the conduct of the 4- 4 educational program in the public schools; 4- 5 (2) For the publication, procurement, and dissemination 4- 6 of curriculum materials, units of instruction, and 4- 7 suggested methods of instruction relating to the 4- 8 influence and effect of alcohol on human health and 4- 9 behavior and on social and economic conditions for the 4-10 schoolteachers and educational officials in the various 4-11 local school systems of the state, the Department of 4-12 Education, and the various educational institutions of 4-13 the state which are engaged in the education and 4-14 training of teachers; and 4-15 (3) For cooperative work, by and between the state 4-16 educational research service and the local school 4-17 systems of the state, the Department of Education, and 4-18 the educational institutions of the state which are 4-19 engaged in the education and training of teachers, 4-20 through conferences, study groups, demonstrations of 4-21 methods and materials of instruction, and other means. 4-22 (e)(f) The state board is authorized to expend such 4-23 amounts as may be necessary of the moneys allocated to it 4-24 under Code Section 20-2-13 for the employment of a 4-25 specialist or specialists or for contracting for the 4-26 services of specialists in research and in development and 4-27 production of curriculum materials and units of 4-28 instruction on the scientific facts in regard to the 4-29 influence of alcohol on human health and behavior and on 4-30 social and economic conditions, including methods of 4-31 instruction; for the employment of secretarial and 4-32 clerical assistants and other office expenses; for 4-33 expenses of conferences, study groups, and demonstrations; 4-34 and for all other expenses necessary in carrying out the 4-35 purposes of this Code section. 4-36 (f)(g) The state board shall make available uniformly to 4-37 the public schools of the state and the educational 4-38 institutions of the state engaged in the education and 4-39 training of teachers the curriculum materials, the units 4-40 of instruction, and the suggested methods of instruction 4-41 which are developed under this Code section." -4- (Index) LC 19 2609S SECTION 2. 5- 1 All laws and parts of laws in conflict with this Act are 5- 2 repealed. -5- (Index)
