SENATE BILL 689

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend an Act creating the Polk County Water Authority,
1- 2 approved April 14, 1967 (Ga. L. 1967, p. 3108), as amended,
1- 3 particularly by an Act approved March 24, 1994 (Ga. L. 1994,
1- 4 p.3876), so as to rename the authority; to add a member to
1- 5 the authority and provide for the qualifications,
1- 6 appointment, and term of office of such member; to provide
1- 7 for veto power of the chairman and for overriding such veto;
1- 8 to provide for related matters; to repeal conflicting laws;
1- 9 and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-11 An Act creating the Polk County Water Authority, approved
1-12 April 14, 1967 (Ga. L. 1967, p. 3108), as amended,
1-13 particularly by an Act approved March 24, 1994 (Ga. L. 1994,
1-14 p. 3876), is amended by striking in its entirety Section 1
1-15 and inserting in lieu thereof the following:
"SECTION 1.
Short title.
1-16 This Act shall be known and may be cited as the 'Polk County
1-17 Water, Sewage, and Solid Waste Authority Act.' The authority
1-18 created by this Act is renamed the Polk County Water,
1-19 Sewage, and Solid Waste Authority, and any reference to the
1-20 Polk County Water Authority or to the authority shall be
1-21 deemed to refer to the Polk County Water, Sewage, and Solid
1-22 Waste Authority."
SECTION 2.
1-23 Said Act is further amended by inserting in Section 2 new
1-24 subsections to be designated subsection (j) and subsection
1-25 (k) to read as follows:
1-26 "(j) Notwithstanding any other provision of this section,
1-27 there shall be a sixth member of the authority, who shall
1-28 be a member of the Polk County Board of Commissioners who
1-29 shall be appointed by such board. Notwithstanding any

2- 1 other provision of this section, such member shall be
2- 2 appointed for a term of one year and may serve an
2- 3 unlimited number of terms as long as such member continues
2- 4 to be a member of the Polk County Board of Commissioners.
2- 5 Notwithstanding any other provision of this section, such
2- 6 member shall not be required to be a user of the
2- 7 facilities of the authority or to reside outside the
2- 8 corporate limits of a municipality. Notwithstanding any
2- 9 other provision of this section, any vacancy in the
2-10 position of the sixth member shall be filled for the
2-11 unexpired term by appointment of the Polk County Board of
2-12 Commissioners.
2-13 (k) Any resolution of the authority may be vetoed by the
2-14 chairman following the adoption of such resolution. To
2-15 veto a resolution, the chairman shall send or cause to be
2-16 sent to each other member of the authority a written
2-17 message specifying the resolution vetoed and the reason
2-18 for such veto within ten days following the adoption of
2-19 such resolution. At the following meeting of the
2-20 authority, if four members of the authority vote to
2-21 override the veto of the chairman, the resolution shall be
2-22 adopted as the policy of the authority."
SECTION 3.
2-23 All laws and parts of laws in conflict with this Act are
2-24 repealed.
