A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 43-15-6 of the Official Code of
1- 2 Georgia Annotated, relating to the powers of the State Board
1- 3 of Registration for Professional Engineers and Land
1- 4 Surveyors, so as to authorize such board to employ a
1- 5 full-time attorney to assist the board in carrying out its
1- 6 functions; to provide for duties for the board's legal
1- 7 assistant; to provide for the qualifications and
1- 8 compensation of such legal assistant; to provide for
1- 9 applicability with respect to the authority of the Attorney
1-10 General; to provide an effective date; to repeal conflicting
1-11 laws; and for other purposes.
1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-13 Code Section 43-15-6 of the Official Code of Georgia
1-14 Annotated, relating to the powers of the State Board of
1-15 Registration for Professional Engineers and Land Surveyors,
1-16 is amended by adding at the end thereof a new subsection (c)
1-17 to read as follows:
1-18 "(c) In addition to the powers provided in subsection (a)
1-19 of this Code section, the board shall be authorized to
1-20 employ an attorney to serve as a legal assistant and
1-21 counselor to the board. The legal assistant shall be
1-22 authorized to review complaints; to present complaints to
1-23 the board; to represent the board in administrative
1-24 hearings involving the disciplining or sanctioning of a
1-25 person registered with the board, the denial of a
1-26 registration to a person applying for registration with
1-27 the board, or action against any unregistered person for
1-28 providing services that require registration; or to
1-29 perform such other duties as may be assigned by the board
1-30 or its executive director. The position of legal
1-31 assistant shall be in the unclassified service of the
1-32 State Merit System of Personnel Administration. The
1-33 person appointed as legal assistant shall be appointed by
1-34 the board, shall serve at the pleasure of the board, and

2- 1 shall be paid a salary set by the board and the
2- 2 joint-secretary. No person may be appointed as legal
2- 3 assistant unless he or she is a member of the State Bar of
2- 4 Georgia and has been a practicing attorney for at least
2- 5 five years. The provisions of this subsection do not
2- 6 affect the authority of the Attorney General to act as the
2- 7 legal adviser of the board and to be the exclusive
2- 8 representative of the board in all courts of law."
SECTION 2.
2- 9 This Act shall become effective upon its approval by the
2-10 Governor or upon its becoming law without such approval.
SECTION 3.
2-11 All laws and parts of laws in conflict with this Act are
2-12 repealed.
