SENATE BILL 75
By: Senators Abernathy of the 38th and Scott of the 36th
A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 26 of the Official Code of
1- 2 Georgia Annotated, relating to standards, labeling, and
1- 3 adulteration of food, so as to require certificates of
1- 4 health, gloves, and hair nets for certain persons who handle
1- 5 food in food service establishments; to repeal conflicting
1- 6 laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Chapter 2 of Title 26 of the Official Code of Georgia
1- 9 Annotated, relating to standards, labeling, and adulteration
1-10 of food, is amended by adding after Code Section 26-2-25 the
1-11 following:
1-12 "26-2-25.1. (Index)
1-13 A person who, in the ordinary course of business in a food
1-14 service establishment, handles food which is to be
1-15 consumed by humans, other than food in an enclosed
1-16 container, shall:
1-17 (1) Have a certificate of health, renewable annually and
1-18 issued by the county board of health, indicating that
1-19 such person had no communicable disease at the time the
1-20 person was examined for the purpose of obtaining the
1-21 certificate; and
1-22 (2) Wear, when handling food other than in an enclosed
1-23 container, appropriate gloves and hair nets to prevent
1-24 contamination of such food."
SECTION 2.
1-25 Said chapter is further amended by adding at the end of Code
1-26 Section 26-2-373, relating to sanitation standards for food
1-27 service establishments, the following:
1-28 "(c) A person who, in the ordinary course of business in a
1-29 food service establishment, handles food which is to be

2- 2 container, shall:
2- 3 (1) Have a certificate of health, renewable annually and

SECTION 3.
2-11 All laws and parts of laws in conflict with this Act are
2-12 repealed.
