SB 779 96 LC 21 3961 SENATE BILL 779 By: Senator Madden of the 47th A BILL TO BE ENTITLED AN ACT 1- 1 To amend the charter for the City of Arcade approved April 1- 2 5, 1995 (Ga. L. 1995, p. 4024), so as to change the 1- 3 corporate limits of that city; to repeal conflicting laws; 1- 4 and for other purposes. 1- 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 6 The charter for the City of Arcade, approved April 5, 1995 1- 7 (Ga. L. 1995, p. 4024), is amended by adding after 1- 8 subsection (a) of Section 1.11 a new subsection to read as 1- 9 follows: 1-10 "(a.1) The corporate boundaries of this city shall not 1-11 include the following described property: TRACT ONE: 1-12 All that tract or parcel of land lying and being in the 1-13 242nd G. M. District of Jackson County, Georgia, 1-14 containing 395.0 acres (net) exclusive of right-of-ways, 1-15 according to a plat of a survey for Southeast Timberlands, 1-16 Inc., made by Byron L. Farmer, Georgia Registered Surveyor 1-17 No. 1679, dated July 1981, and recorded at Plat Book 18, 1-18 page 71, Clerk's Office, Jackson County Superior Court, 1-19 which plat by this reference thereto is incorporated 1-20 herein for a more particular and accurate description of 1-21 the property herein conveyed; said property being more 1-22 particularly described according to said plat as follows: 1-23 BEGINNING at an iron pin located on the northerly 1-24 right-of-way line of U.S. Highway 129 which iron pin 1-25 separates the property herein conveyed from property now 1-26 or formerly of H. W. Davis; running thence along the 1-27 northerly right-of-way line of U.S. Highway 129 the 1-28 following courses and distances: north 66 degrees 16 1-29 minutes 9 seconds west 129.3 feet, north 71 degrees 26 1-30 minutes 38 seconds west 148.3 feet, north 77 degrees 40 1-31 minutes 41 seconds west 152.3 feet, north 83 degrees 29 S. M., Jackson 4- 5 County, Georgia, and being more particularly described as 4- 6 Tract I, containing 109.863 acres, Tract II containing 4- 7 1008.010 acres, Tract III containing .705 acres and Tract 4- 8 IV containing 11.366 acres, making a total of 1129.944 4- 9 acres, all according to a plat by James M. Paul, Surveyor, 4-10 dated February 25, 1976, entitled 'Survey for Doyle W. 4-11 Terry Estate,' said plat being recorded in Plat Book 12, 4-12 page 44, in the office of the Clerk of the Superior Court 4-13 of Jackson County, Georgia, to which reference is hereby 4-14 specifically made for a more detailed description of the 4-15 property herein conveyed. TRACT THREE: 4-16 All that tract or parcel lying and being in the 257th 4-17 District, G.M., Jackson County, Georgia, containing 189.65 4-18 acres, more or less, as shown and delineated on a plat of 4-19 survey entitled, 'Survey for Taratoot and Associates, 4-20 Inc.,' prepared by Tyson and Associates, Inc., Registered 4-21 Surveyors, dated April 26, 1974, and recorded in the 4-22 Office of the Clerk of the Superior Court, Jackson County, 4-23 Georgia, in Plat Book 9, page 224, reference being hereby 4-24 made to said plat for a more complete description of the 4-25 property herein conveyed."
