SR 10295 LC 18 6625 SENATE RESOLUTION 102 By: Senator Cheeks of the 23rd A RESOLUTION 1- 1 Authorizing the leasing of certain real property owned by 1- 2 the Georgia Building Authority in Richmond County, Georgia; 1- 3 to provide an effective date; and for other purposes. 1- 4 WHEREAS, the Georgia Building Authority is the owner of 1- 5 certain real property consisting of 17.2 acres located in 1- 6 Richmond County, Georgia; and 1- 7 WHEREAS, pursuant to Resolution Act 9, H.R. 74, Ga. L. 1991, 1- 8 p. 1184, approved April 12, 1991, the above described 1- 9 property was leased to the Richmond County Board of Health; 1-10 and 1-11 WHEREAS, Richmond County is desirous of leasing a portion of 1-12 the above mentioned leased property for the purpose of 1-13 locating a Georgia State Patrol driver's license facility; 1-14 and 1-15 WHEREAS, said real tract of land, hereinafter referred to as 1-16 "the Premises," is more particularly described as follows: 1-17 All that tract or parcel of land containing five acres, 1-18 more or less, lying and being in the 86th Georgia Militia 1-19 District of Richmond County, Georgia, and being more 1-20 particularly described on that certain plat of survey 1-21 entitled "Richmond County Board of Health" dated October 1-22 22, 1990, and revised May 18, 1994, by William F. Todd, 1-23 Jr., Georgia Registered Land Surveyor No. 2506; and 1-24 WHEREAS, the Richmond County Board of Health has agreed to 1-25 release the premises from its lease with the Georgia 1-26 Building Authority. 1-27 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL 1-28 ASSEMBLY OF GEORGIA: S. R. 102 -1- (Index) LC 18 6625 SECTION 1. 2- 1 That the premises are owned by Georgia Building Authority or 2- 2 may now or in the future be owned by the State of Georgia, 2- 3 in whole or in part. In all matters relating to the 2- 4 conveyance of an estate for years authorized by this 2- 5 resolution, where property is owned by the State, the State 2- 6 of Georgia shall act by and through the Georgia Building 2- 7 Authority. SECTION 2. 2- 8 That the Georgia Building Authority is authorized to convey 2- 9 or let to Richmond County an estate for years or a usufruct 2-10 in the premises with a term not to exceed 50 years and a 2-11 parcel size of not more than five acres. The estate for 2-12 years or usufruct shall be for the purpose of providing 2-13 public safety services. The consideration for the 2-14 conveyance shall be $10.00 dollars. The term of the estate 2-15 for years or usufruct and the means of ingress and egress 2-16 shall be subject to the prior approval of the Board of Human 2-17 Resources. SECTION 3. 2-18 The lease provided for in Section 2 of this resolution shall 2-19 be conditioned upon the Richmond County Board of Health's 2-20 relinquishment of interest in the five acre parcel from its 2-21 March 20, 1992, 50 year lease by appropriate instrument. SECTION 4. 2-22 That this lease agreement shall be recorded by the Grantee 2-23 in the Superior Court of Richmond County and a recorded copy 2-24 shall be forwarded to the Georgia Building Authority. SECTION 5. 2-25 That this resolution shall become effective upon its 2-26 approval by the Governor or upon its becoming law without 2-27 such approval. SECTION 6. 2-28 That all laws and parts of laws in conflict with this Act 2-29 are repealed. S. R. 102 -2- (Index)
