SR 228 95 SR228/AP SENATE RESOLUTION 228 By: Senators Johnson of the 1st and Johnson of the 2nd A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to allow 1- 2 the owners of certain real property located in certain 1- 3 industrial areas to remove the property from the industrial 1- 4 area; to provide that such removal shall be irrevocable and 1- 5 binding on successors and heirs; to provide for the 1- 6 submission of this amendment for ratification or rejection; 1- 7 and for other purposes. SECTION 1. 1- 8 Article XI, Section I, Paragraph IV of the Constitution is 1- 9 amended by adding at the end thereof a new subparagraph (e) 1-10 to read as follows: 1-11 "(e) Any person owning property in an industrial area 1-12 described in subparagraph (d) may voluntarily remove the 1-13 property from the industrial area by filing a certificate 1-14 to that effect with the clerk of the superior court for 1-15 the county in which the property is located, but only if 1-16 the property is located on an island. Once the 1-17 certificate is filed, the property described in the 1-18 certificate, together with all public streets and public 1-19 rights of way within the property, abutting the property, 1-20 or connecting the property to property outside the 1-21 industrial area will no longer be in the industrial area 1-22 and may be annexed by an adjacent city. The filing of a 1-23 certificate will be irrevocable and will bind the owners, 1-24 their heirs, and their assigns. The term 'owner' includes 1-25 anyone with a legal or equitable ownership in property but 1-26 does not include a beneficiary of any trust or a partner 1-27 in any partnership owning an interest in the property or 1-28 anyone owning an easement right in the property." SECTION 2. 1-29 The above proposed amendment to the Constitution shall be 1-30 published and submitted as provided in Article X, Section I, 1-31 Paragraph II of the Constitution. 1-32 The ballot submitting the above proposed amendment shall 1-33 have written or printed thereon the following: S. R. 228 -1- (Index) SR228/AP 2- 1 "( ) YES Shall the Constitution be amended so as to 2- 2 allow the owner of island property located 2- 3 ( ) NO within a constitutional industrial area 2- 4 voluntarily to remove the property from the 2- 5 industrial area?" 2- 6 All persons desiring to vote in favor of ratifying the 2- 7 proposed amendment shall vote "Yes." All persons desiring 2- 8 to vote against ratifying the proposed amendment shall vote 2- 9 "No." 2-10 If such amendment shall be ratified as provided in said 2-11 Paragraph of the Constitution, it shall become a part of the 2-12 Constitution of this state.
