SR 24 95 LC 23 0175 SENATE RESOLUTION 24 By: Senators Newbill of the 56th, Clay of the 37th, Gochenour of the 27th and others A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to provide 1- 2 for the election of the members of the State Board of 1- 3 Education by the members of the General Assembly from the 1- 4 respective congressional districts and for a State School 1- 5 Superintendent to be appointed by the board; to provide an 1- 6 effective date; to provide for the submission of this 1- 7 amendment for ratification or rejection; and for other 1- 8 purposes. 1- 9 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Article VIII, Section II, Paragraph I of the Constitution is 1-11 amended by striking subparagraph (a), which reads as 1-12 follows: 1-13 "(a) There shall be a State Board of Education which 1-14 shall consist of one member from each congressional 1-15 district in the state appointed by the Governor and 1-16 confirmed by the Senate. The Governor shall not be a 1-17 member of said board. The ten members in office on June 1-18 30, 1983, shall serve out the remainder of their 1-19 respective terms. As each term of office expires, the 1-20 Governor shall appoint a successor as herein provided. 1-21 The terms of office of all members appointed after the 1-22 effective date of this Constitution shall be for seven 1-23 years. Members shall serve until their successors are 1-24 appointed and qualified. In the event of a vacancy on the 1-25 board by death, resignation, removal, or any reason other 1-26 than expiration of a member's term, the Governor shall 1-27 fill such vacancy; and the person so appointed shall serve 1-28 until confirmed by the Senate and, upon confirmation, 1-29 shall serve for the unexpired term of office.", 1-30 in its entirety and inserting in lieu thereof a new 1-31 subparagraph (a) to read as follows: 1-32 "(a) There shall be a State Board of Education composed 1-33 of as many members as there are congressional districts in 1-34 the state. The member of the board from each 1-35 congressional district shall be elected by a majority vote S. R. 24 -1- (Index) LC 23 0175 2- 1 of the qualified electors of the state. The board shall 2- 2 be elected at the same time, for the same term, and in the 2- 3 same manner as the Governor." SECTION 2. 2- 4 Article VIII, Section III, Paragraph I of the Constitution 2- 5 is amended by striking Paragraph I in its entirety and 2- 6 inserting in lieu thereof a new Paragraph I to read as 2- 7 follows: 2- 8 "Paragraph I. State School Superintendent. There shall 2- 9 be a State School Superintendent, who shall be the 2-10 executive officer of the State Board of Education, elected 2-11 at the same time and in the same manner and for the same 2-12 term as that of the Governor appointed by the State Board 2-13 of Education as provided by law. The State School 2-14 Superintendent shall have serve at the pleasure of the 2-15 board and shall hold such qualifications and shall be paid 2-16 such compensation as may be fixed provided by law. No 2-17 member of the State Board of Education shall be eligible 2-18 for election as State School Superintendent during the 2-19 time for which such member shall have been appointed." SECTION 3. 2-20 This amendment shall become effective January 1, 1996, and 2-21 the terms of the members in office on December 31, 1995, 2-22 shall terminate. The State School Superintendent serving at 2-23 the time of the ratification of this amendment shall serve 2-24 out the remainder of the term for which elected, and the 2-25 office shall cease to be an elected office at the 1996 2-26 general election. SECTION 4. 2-27 The above proposed amendment to the Constitution shall be 2-28 published and submitted as provided in Article X, Section I, 2-29 Paragraph II of the Constitution. 2-30 The ballot submitting the above proposed amendment shall 2-31 have written or printed thereon the following: 2-32 "( ) YES Shall the Constitution be amended so as to 2-33 provide for the election of the members of the 2-34 ( ) NO State Board of Education from the respective 2-35 congressional districts and for a State School 2-36 Superintendent to be appointed by the board?" 2-37 All persons desiring to vote in favor of ratifying the 2-38 proposed amendment shall vote "Yes." All persons desiring S. R. 24 -2- (Index) LC 23 0175 3- 1 to vote against ratifying the proposed amendment shall vote 3- 2 "No." 3- 3 If such amendment shall be ratified as provided in said 3- 4 Paragraph of the Constitution, it shall become a part of the 3- 5 Constitution of this state.
