SR 97 LC 14 6683S A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to provide 1- 2 that there may be created by law a State Compensation 1- 3 Commission and so as to require that before the compensation 1- 4 of state officials is increased the increase must be 1- 5 approved by the commission; to provide for related matters; 1- 6 to provide for the submission of this amendment for 1- 7 ratification or rejection; and for other purposes. 1- 8 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Article III, Section I of the Constitution is amended by 1-10 adding at its end a new Paragraph II to read as follows: 1-11 "Paragraph II. State Compensation Commission. The 1-12 General Assembly is authorized to create by law a State 1-13 Compensation Commission and to delegate to such commission 1-14 the power to set the compensation of officers of the 1-15 executive, legislative, and judicial branches of 1-16 government. Any such law may, but shall not be required 1-17 to, specify procedures whereby compensation fixed by the 1-18 commission may be rejected or reduced, but not increased, 1-19 by resolution of the General Assembly. Officers covered by 1-20 such law may include Justices of the Supreme Court; Judges 1-21 of the Court of Appeals; judges of the superior court; 1-22 district attorneys; members and officers of the General 1-23 Assembly; the Governor and Lieutenant Governor; elected 1-24 constitutional officers of the executive branch; the chief 1-25 officers of state departments, bureaus, boards, agencies, 1-26 authorities, and other entities of state government, by 1-27 whatever name called, and such other officers as may be 1-28 specified by such law. With respect to any officer covered 1-29 by such law, the power delegated to the commission shall 1-30 be exclusive and the General Assembly shall, for so long 1-31 as the commission remains in existence, have no power to 1-32 change the compensation of any such officer except to the 1-33 extent that such law provides for reductions by 1-34 legislative resolution of compensation fixed by the 1-35 commission. The provisions of this Paragraph shall control 1-36 over any other conflicting provisions to the extent that -1- (Index) LC 14 6683S 2- 1 the General Assembly shall be authorized to delegate to 2- 2 the commission the power to fix compensation which would 2- 3 otherwise be fixed by the General Assembly or in some 2- 4 other manner. Compensation to be set as provided in this 2- 5 Paragraph may include salary, expense allowances and 2- 6 expense reimbursement, and any other form of compensation, 2- 7 as specified in the law implementing this Paragraph." SECTION 2. 2- 8 The above proposed amendment to the Constitution shall be 2- 9 published and submitted as provided in Article X, Section I, 2-10 Paragraph II of the Constitution. 2-11 The ballot submitting the above proposed amendment shall 2-12 have written or printed thereon the following: 2-13 "( ) YES Shall the Constitution be amended so as to 2-14 provide that there may be created by law a 2-15 ( ) NO State Compensation Commission and so as to 2-16 require that before the compensation of state 2-17 officials is increased the increase must be 2-18 approved by the commission?" 2-19 All persons desiring to vote in favor of ratifying the 2-20 proposed amendment shall vote "Yes." All persons desiring 2-21 to vote against ratifying the proposed amendment shall vote 2-22 "No." 2-23 If such amendment shall be ratified as provided in said 2-24 Paragraph of the Constitution, it shall become a part of the 2-25 Constitution of this state. -2- (Index)
