                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 48-5-41 of the Official Code of 
  1- 2  Georgia Annotated, relating to exemptions from ad valorem 
  1- 3  taxation, so as to provide for an exemption for certain 
  1- 4  antique hobby aircraft; to provide for a definition; to 
  1- 5  provide for applicability; to provide for effective dates; 
  1- 6  to provide for a special election; to repeal conflicting 
  1- 7  laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 48-5-41 of the Official Code of Georgia 
  1-11  Annotated, relating to exemptions from ad valorem taxation, 
  1-12  is amended in subsection (a) by striking "and" at the end of 
  1-13  paragraph (14), by striking the period at the end of 
  1-14  paragraph (15) and inserting in its place "; and", and by 
  1-15  adding immediately following paragraph (15) a new paragraph 
  1-16  to be designated paragraph (16), to read as follows: 
 
  1-17      "(16) All antique hobby aircraft owned by one or more 
  1-18      individuals for hobby use and not for hire.  As used in 
  1-19      this paragraph, 'antique hobby aircraft' shall mean an 
  1-20      airplane, rotorcraft, glider, air balloon, or other 
  1-21      similar craft designed for flight purposes for which 
  1-22      January 1 of the tax year falls at least 40 years from 
  1-23      its date of manufacture and which is designed to carry 
  1-24      four or fewer passengers." 
 
  1-25                           SECTION 2. 
 
  1-26  Unless prohibited by the federal Voting Rights Act of 1965, 
  1-27  as amended, the Secretary of State shall call and conduct a 
  1-28  special election for the approval or disapproval of this Act 
  1-29  on the date of and in conjunction with the November, 1998, 
  1-30  general election.  The Secretary of State shall cause the 
  1-31  date and purpose of the special election to be published in 
  1-32  the official organ of each county in the state once a week 
  1-33  for two weeks immediately preceding the date of the

  2- 1  referendum.  The ballot shall have written thereon the 
  2- 2  following: 
 
  2- 3    "(  ) YES Shall the Act be approved which grants an 
  2- 4              exemption from ad valorem taxation for certain 
  2- 5     (  ) NO  antique hobby aircraft?" 
 
  2- 6  All persons desiring to vote for approval of the Act shall 
  2- 7  vote "Yes," and those persons desiring to vote for rejection 
  2- 8  of the Act shall vote "No."  If more than one-half of the 
  2- 9  votes cast on such question are for approval of the Act, 
  2-10  then Section 1 of this Act shall become effective on January 
  2-11  1, 1999, and shall apply to all tax years beginning on or 
  2-12  after that date; otherwise Section 1 of this Act shall be 
  2-13  void and this Act shall stand repealed in its entirety on 
  2-14  January 1, 1999. 
 
  2-15                           SECTION 3. 
 
  2-16  Except as otherwise provided in Section 2 of this Act, this 
  2-17  Act shall become effective January 1, 1998. 
 
  2-18                           SECTION 4. 
 
  2-19  All laws and parts of laws in conflict with this Act are
