                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 48-8-3 of the Official Code of Georgia 
  1- 2  Annotated, relating to exemptions from state sales and use 
  1- 3  tax, so as to provide for an exemption with respect to sales 
  1- 4  of home study program yearbooks to students enrolled in such 
  1- 5  programs; to provide for conditions and limitations; to 
  1- 6  provide an effective date; to repeal conflicting laws; and 
  1- 7  for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 48-8-3 of the Official Code of Georgia 
  1-11  Annotated, relating to exemptions from state sales and use 
  1-12  tax, is amended by striking "or" at the end of paragraph 
  1-13  (59); by striking the period at the end of paragraph (60) 
  1-14  and inserting in its place "; or"; and by adding a new 
  1-15  paragraph immediately following paragraph (60), to be 
  1-16  designated paragraph (61), to read as follows: 
 
  1-17        "(61)(A) Sales of home study program yearbooks to 
  1-18        students who are enrolled in a bona fide home study 
  1-19        program. 
 
  1-20        (B) Any person making a sale of a home study program 
  1-21        yearbook shall collect the tax imposed on the sale by 
  1-22        this article unless the purchaser furnishes such 
  1-23        person with a certificate issued by the commissioner 
  1-24        certifying that the purchaser is entitled to purchase 
  1-25        the home study program yearbook without paying the 
  1-26        tax." 
 
  1-27                           SECTION 2. 
 
  1-28  This Act shall become effective on January 1, 1999. 
 
  1-29                           SECTION 3. 
 
  1-30  All laws and parts of laws in conflict with this Act are 
  1-31  repealed.
