A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 48-8-3 of the Official Code of Georgia
1- 2 Annotated, relating to exemptions from sales and use
1- 3 taxation, so as to provide an exemption for nonprescription
1- 4 drugs; to provide for related matters; to provide an
1- 5 effective date; to repeal conflicting laws; and for other
1- 6 purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Code Section 48-8-3 of the Official Code of Georgia
1-10 Annotated, relating to exemptions from sales and use
1-11 taxation, is amended by striking paragraph 47 and inserting
1-12 in its place a new paragraph to read as follows:
1-13 "(47) Sales of drugs dispensed by prescription and
1-14 prescription eyeglasses and contact lenses and on and
1-15 after January 1, 1998, the sale of nonprescription
1-16 drugs. For purposes of this exemption, the term
1-17 'nonprescription drugs' shall include such of the
1-18 following as may lawfully be sold without a
1-19 prescription: articles recognized as of January 1, 1997,
1-20 in the official United States Pharmacopoeia, official
1-21 Homeopathic Pharmacopoeia of the United States, or
1-22 official National Formulary, or any then existing
1-23 supplement to any of them and articles intended for use
1-24 in the diagnosis, cure, mitigation, treatment, or
1-25 prevention of disease in humans. Such term, however,
1-26 shall not include devices or their components, parts, or
1-27 accessories;".
1-28 SECTION 2.
1-29 This Act shall become effective on January 1, 1998.
1-30 SECTION 3.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
