                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 48-8-3 of the Official Code of Georgia 
  1- 2  Annotated, relating to exemptions from state sales and use 
  1- 3  taxes, so as to provide for an exemption with respect to the 
  1- 4  sale or use of machinery or equipment, or both, which is 
  1- 5  used directly in the remanufacture of aircraft engines or 
  1- 6  aircraft engine parts or components; to provide for 
  1- 7  conditions and limitations; to provide an effective date; to 
  1- 8  repeal conflicting laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Code Section 48-8-3 of the Official Code of Georgia 
  1-12  Annotated, relating to exemptions from state sales and use 
  1-13  taxes, is amended by striking paragraph (34.2) and inserting 
  1-14  in its place a new paragraph (34.2) to read as follows: 
 
  1-15        "(34.2)(A) The sale or use of machinery or equipment, 
  1-16        or both, which is used directly in the remanufacture 
  1-17        of aircraft engines or aircraft engine parts or 
  1-18        components in a remanufacturing facility located in 
  1-19        this state.  For purposes of this paragraph, 
  1-20        'remanufacture of aircraft engines or aircraft engine 
  1-21        parts or components' means the substantial overhauling 
  1-22        or rebuilding of aircraft engines or aircraft engine 
  1-23        parts or components on a factory basis. 
 
  1-24        (B) Any person making a sale of machinery or 
  1-25        equipment, or both, for the remanufacture of aircraft 
  1-26        engines or aircraft engine parts or components shall 
  1-27        collect the tax imposed on the sale by this article 
  1-28        unless the purchaser furnishes a certificate issued by 
  1-29        the commissioner certifying that the purchaser is 
  1-30        entitled to purchase the machinery without paying the 
  1-31        tax;".

  2- 1                           SECTION 2. 
 
  2- 2  Notwithstanding any provision of Code Section 1-3-4.1 to the 
  2- 3  contrary, this Act shall become effective upon its approval 
  2- 4  by the Governor or upon its becoming law without such 
  2- 5  approval. 
 
  2- 6                           SECTION 3. 
 
  2- 7  All laws and parts of laws in conflict with this Act are
