A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Part 2 of Article 10 of Chapter 6 of Title 40 of
1- 2 the Official Code of Georgia Annotated, relating to parking
1- 3 for persons with disabilities, so as to change the
1- 4 conditions under which a parking permit may be issued to an
1- 5 institution transporting one or more persons with
1- 6 disabilities; to provide for other related matters; to
1- 7 provide an effective date; to repeal conflicting laws; and
1- 8 for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Part 2 of Article 10 of Chapter 6 of Title 40 of the
1-12 Official Code of Georgia Annotated, relating to parking for
1-13 persons with disabilities, is amended by striking
1-14 subsections (a) and (c) of Code Section 40-6-222, relating
1-15 to handicapped parking permits, and inserting in their
1-16 respective places new subsections (a) and (c) of said Code
1-17 section to read as follows:
1-18 "(a) The Department of Public Safety shall issue parking
1-19 permits for persons with disabilities at every place where
1-20 it issues drivers' licenses. The department shall also
1-21 receive applications for from and issue parking permits
1-22 for persons with disabilities by mail and may by
1-23 regulation require such proof of disability or incapacity
1-24 as may be necessary to issue such permits by mail. Permits
1-25 shall be in such form as the department prescribes but
1-26 shall be of sufficient size and sufficiently distinctively
1-27 marked to be easily visible when placed on or affixed to
1-28 the dashboard or hung from the rearview mirror of the
1-29 parked vehicle. Permits shall be issued to individuals,
1-30 and the name of the individual shall appear on the permit.
1-31 The individual to whom a permit is issued may use the
1-32 permit for any vehicle he or she is operating or in which
1-33 he or she is a passenger. Permits shall also be issued to
1-34 institutions when: (1) the primary purpose of a vehicle
1-35 operated by the institution is to transport individuals

2- 1 persons with disabilities; or (2) the institution is a
2- 2 governmentally owned or operated senior citizens center
2- 3 which on a regular basis operates a vehicle transporting
2- 4 one or more persons with disabilities. The name of the
2- 5 institution and the license number of the particular
2- 6 vehicle shall appear on the permit. The institution may
2- 7 use such permit only for a vehicle which is operated by
2- 8 the institution and which is used primarily to transport
2- 9 individuals with disabilities."
2-10 "(c) The department shall issue a permanent permit to any
2-11 person who is obviously permanently disabled and to any
2-12 other permanently disabled person upon presentation of a
2-13 licensed medical doctor's affidavit stating that such
2-14 person is a permanently disabled person. The department
2-15 shall also issue a permanent permit to an institution
2-16 which operates vehicles used primarily for the
2-17 transportation of individuals with disabilities meets the
2-18 criteria specified in subsection (a) of this Code section,
2-19 upon presentation of a certification from the institution
2-20 regarding use of its vehicles. The institution shall
2-21 receive permits only for the number of vehicles so used
2-22 and shall affix the permits to the dashboards of such
2-23 vehicles. The permanent permit shall be predominantly
2-24 blue in color and shall show prominently on its face an
2-25 expiration date four years from the date it is issued."
2-26 SECTION 2.
2-27 This Act shall become effective upon its approval by the
2-28 Governor or upon its becoming law without such approval.
2-29 SECTION 3.
2-30 All laws and parts of laws in conflict with this Act are
2-31 repealed.
