A RESOLUTION
1- 1 Authorizing the conveyance of certain state owned real
1- 2 property located in Mitchell County, Georgia; to repeal
1- 3 conflicting laws; and for other purposes.
1- 4 WHEREAS, the State of Georgia is the owner of a certain
1- 5 parcel of real property located in the City of Pelham,
1- 6 Mitchell County, Georgia; and
1- 7 WHEREAS, said real property is all that tract or parcel of
1- 8 land lying and being in the City of Pelham, Mitchell County,
1- 9 Georgia, as described on that certain preliminary plat of
1-10 survey prepared by Leroy R. Hall, Georgia Registered Land
1-11 Surveyor No. 2504, dated December 23, 1996, and on file in
1-12 the offices of the State Properties Commission, and may be
1-13 more particularly described on a plat of survey prepared by
1-14 a Georgia registered land surveyor and presented by the
1-15 grantee to the State Properties Commission for approval; and
1-16 WHEREAS, said property is under the custody of the
1-17 Department of Agriculture as an unimproved portion of the
1-18 Pelham Farmers' Market site; and
1-19 WHEREAS, the Department of Agriculture has determined that
1-20 the subject property is not required to support its current
1-21 mission or any anticipated future mission; and
1-22 WHEREAS, the City of Pelham, Mitchell County, is desirous of
1-23 obtaining the subject property.
1-24 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL
1-25 ASSEMBLY OF GEORGIA:
1-26 SECTION 1.
1-27 That the State of Georgia is the owner of the
1-28 above-described real property and that in all matters
1-29 relating to the conveyance of the real property the State of
1-30 Georgia is acting by and through its State Properties
1-31 Commission.
1-32 SECTION 2.
1-33 That the above-described real property shall be conveyed by
1-34 appropriate instrument to the City of Pelham, Mitchell

2- 1 County, by the State of Georgia, acting by and through the
2- 2 State Properties Commission, for the consideration of $10.00
2- 3 so long as the property is used for public purposes and such
2- 4 further consideration and provisions as the State Properties
2- 5 Commission shall in its discretion determine to be in the
2- 6 best interests of the State of Georgia.
2- 7 SECTION 3.
2- 8 That, if the City of Pelham, Mitchell County, determines the
2- 9 need to convey all or a portion of the above-described
2-10 property to a private person or corporation or other entity,
2-11 then, before any such disposition, the State Properties
2-12 Commission shall have first approved both the disposition
2-13 and the monetary consideration for said disposition, which
2-14 consideration shall not be less than the fair market value
2-15 of such property. Any such State Properties Commission
2-16 approval shall be conditioned on said monetary
2-17 consideration, less any incurred expenses of disposition
2-18 which have been approved by the State Properties Commission,
2-19 being received and deposited by the State Properties
2-20 Commission into the treasury of the State of Georgia.
2-21 SECTION 4.
2-22 That the authorization in this resolution to convey the
2-23 above-described property to the City of Pelham, Mitchell
2-24 County, shall expire three years after the date that this
2-25 resolution becomes effective.
2-26 SECTION 5.
2-27 That the State Properties Commission is authorized and
2-28 empowered to do all acts and things necessary and proper to
2-29 effect such conveyance.
2-30 SECTION 6.
2-31 That the deed of conveyance shall be recorded by the grantee
2-32 in the Superior Court of Mitchell County and a recorded copy
2-33 shall be forwarded to the State Properties Commission.
2-34 SECTION 7.
2-35 That all laws and parts of laws in conflict with this
2-36 resolution are repealed.
