                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 49-5-12 of the Official Code of 
  1- 2  Georgia Annotated, relating to licensing and inspection of 
  1- 3  child welfare agencies and child care facilities, so as to 
  1- 4  redefine the term "child welfare agency" to include certain 
  1- 5  child care facilities located in shopping centers, malls, 
  1- 6  and office complexes; to provide an effective date; to 
  1- 7  repeal conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 49-5-12 of the Official Code of Georgia 
  1-11  Annotated, relating to licensing and inspection of child 
  1-12  welfare agencies and child care facilities, is amended by 
  1-13  striking subsection (a) thereof and inserting in its place 
  1-14  the following: 
 
  1-15    "(a) 'Child welfare agency' means any child-caring 
  1-16    institution, child-placing agency, maternity home, family 
  1-17    day-care home, group day-care home, or day-care center, or 
  1-18    child care facility located in a shopping center, mall, or 
  1-19    office complex and operated by the owners of such business 
  1-20    establishments for the temporary, short-term care of 
  1-21    children on a fee basis." 
 
  1-22                           SECTION 2. 
 
  1-23  This Act shall become effective on July 1 of the fiscal year 
  1-24  for which funds necessary to carry out its purposes are 
  1-25  specifically appropriated by the General Assembly or on July 
  1-26  1 of the following fiscal year if funds are first 
  1-27  appropriated in a supplemental appropriations Act. 
 
  1-28                           SECTION 3. 
 
  1-29  All laws and parts of laws in conflict with this Act are 
  1-30  repealed.
