                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 36-82-1 of the Official Code of 
  1- 2  Georgia Annotated, relating to election for bonded debt, so 
  1- 3  as to provide that bond elections shall be held on the date 
  1- 4  of the November general election except under certain 
  1- 5  circumstances; to amend Code Section 21-3-11 of the Official 
  1- 6  Code of Georgia Annotated, relating to calling of municipal 
  1- 7  bond elections, so as to provide that bond elections shall 
  1- 8  be held on the date of the November general election except 
  1- 9  under certain circumstances; to provide for related matters; 
  1-10  to provide for an effective date and applicability; to 
  1-11  repeal conflicting laws; and for other purposes. 
 
  1-12       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-13                           SECTION 1. 
 
  1-14  Code Section 36-82-1 of the Official Code of Georgia 
  1-15  Annotated, relating to election for bonded debt, is amended 
  1-16  by striking subsection (b.1) of said Code section and 
  1-17  inserting in lieu thereof a new subsection (b.1) to read as 
  1-18  follows: 
 
  1-19    "(b.1) In all counties of this state having a population 
  1-20    of 550,000 or more according to the United States 
  1-21    decennial census of 1980 or any future such census, no 
  1-22    county-wide No county or municipal bond election or school 
  1-23    bond election in the unincorporated area of any such 
  1-24    county shall be held on any date other than the date of 
  1-25    the November general election; provided, however, that 
  1-26    upon a determination by any superior court of competent 
  1-27    jurisdiction that the holding of such election on the date 
  1-28    of the November general election would cause irreparable 
  1-29    harm to the electors of any such county or municipality or 
  1-30    to the electors residing within the territorial limits of 
  1-31    the school district desiring to incur the bonded debt, 
  1-32    such election shall be held in the manner provided for in 
  1-33    subsection (b) of this Code section."

  2- 1                           SECTION 2. 
 
  2- 2  Code Section 21-3-11 of the Official Code of Georgia 
  2- 3  Annotated, relating to calling of municipal bond elections, 
  2- 4  is amended by striking in its entirety subsection (b) of 
  2- 5  said Code section, and inserting in lieu thereof a new 
  2- 6  subsection (b) to read as follows: 
 
  2- 7    "(b) The date of a municipal bond election shall be 
  2- 8    specified by the governing authority of the municipality. 
  2- 9    Such date shall not be less than 30 days after call of 
  2-10    such bond election, nor shall such election be held on any 
  2-11    date other than the date of the November general election; 
  2-12    provided, however, that upon a determination by any 
  2-13    superior court of competent jurisdiction that the holding 
  2-14    of such election on the date of the November general 
  2-15    election would cause irreparable harm to the electors of 
  2-16    any such municipality, such election shall be held in the 
  2-17    manner provided for in subsection (a) of this Code 
  2-18    section." 
 
  2-19                           SECTION 3. 
 
  2-20  This Act shall become effective on July 1, 1997, and shall 
  2-21  apply to all revenue bonds issued on or after July 1, 1997. 
 
  2-22                           SECTION 4. 
 
  2-23  All laws and parts of laws in conflict with this Act are
