                             A RESOLUTION 
 
  1- 1  Authorizing the conveyance of certain state owned real 
  1- 2  property located in Gwinnett County, Georgia; to repeal 
  1- 3  conflicting laws; and for other purposes. 
 
  1- 4  WHEREAS, the Stone Mountain Memorial Association is the 
  1- 5  owner of two certain parcels of real property or property 
  1- 6  interests located in Gwinnett County, Georgia; and 
 
  1- 7  WHEREAS, said real properties are all those tracts or 
  1- 8  parcels of land lying and being in Land Lots 59 and 60 of 
  1- 9  the 6th District of Gwinnett County, Georgia, consisting of 
  1-10  Tract B and Tract D containing 1.479 acres and 1.126 acres, 
  1-11  respectively, as shown on a plat of survey prepared by O. 
  1-12  Eugene Kay, Georgia Registered Land Surveyor No. 1943, dated 
  1-13  March 5, 1996, on file in the offices of the Stone Mountain 
  1-14  Memorial Association, and may be more particularly described 
  1-15  on a plat of survey prepared by a Georgia registered land 
  1-16  surveyor and presented to the Stone Mountain Memorial 
  1-17  Association for approval; and 
 
  1-18  WHEREAS, the Stone Mountain Memorial Association has 
  1-19  determined that the above-described properties are no longer 
  1-20  needed and are, therefore, surplus to its needs. 
 
  1-21  NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL 
  1-22  ASSEMBLY OF GEORGIA: 
 
  1-23                           SECTION 1. 
 
  1-24  That the Stone Mountain Memorial Association is the owner of 
  1-25  the above-described real property and that in all matters 
  1-26  relating to the conveyance of the real property the State of 
  1-27  Georgia is acting by and through its Stone Mountain Memorial 
  1-28  Association. 
 
  1-29                           SECTION 2. 
 
  1-30  That the above-described parcels may be sold for a 
  1-31  consideration of not less than the fair market value or 
  1-32  exchanged for other properties of equal value as determined 
  1-33  by the Stone Mountain Memorial Association to be in the best 
  1-34  interest of the State of Georgia and such further 
  1-35  consideration and provisions as the Stone Mountain Memorial

  2- 1  Association shall in its discretion determine to be in the 
  2- 2  best interest of the State of Georgia. 
 
  2- 3                           SECTION 3. 
 
  2- 4  That the Stone Mountain Memorial Association is authorized 
  2- 5  and empowered to do all acts and things necessary and proper 
  2- 6  to effect such sale or exchange. 
 
  2- 7                           SECTION 4. 
 
  2- 8  That the deeds of conveyance shall be recorded by the 
  2- 9  grantee in the Superior Court of Gwinnett County and a 
  2-10  recorded copy shall be forwarded to the State Properties 
  2-11  Commission. 
 
  2-12                           SECTION 5. 
 
  2-13  That all laws and parts of laws in conflict with this
