A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 34-9-360 of the Official Code of
1- 2 Georgia Annotated, relating to reimbursement of employers or
1- 3 insurers for subsequent injury compensation payments and
1- 4 amounts of and prerequisites to reimbursement from the
1- 5 Subsequent Injury Trust Fund, so as to change certain
1- 6 provisions relating to eligibility for reimbursement from
1- 7 the fund; to repeal conflicting laws; and for other
1- 8 purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Code Section 34-9-360 of the Official Code of Georgia
1-12 Annotated, relating to reimbursement of employers or
1-13 insurers for subsequent injury compensation payments and
1-14 amounts of and prerequisites to reimbursement from the
1-15 Subsequent Injury Trust Fund, is amended by striking
1-16 subsection (b) and inserting in lieu thereof the following:
1-17 "(b) An employer or insurer who has paid medical and
1-18 rehabilitation expenses on behalf of the employee who
1-19 comes under this article shall be entitled to
1-20 reimbursement from the fund on the following basis:
1-21 (1) Fifty percent reimbursement of all medical and
1-22 rehabilitation expenses paid which exceed $5,000.00
1-23 $10,000.00 but do not exceed $10,000.00 $20,000.00;
1-24 (2) One hundred percent reimbursement of all medical and
1-25 rehabilitation expenses paid which exceed $10,000.00
1-26 $20,000.00;
1-27 provided, however, that the threshold amounts provided by
1-28 paragraphs (1) and (2) of this subsection which entitle an
1-29 employer or insurer to reimbursement shall be increased on
1-30 January 1 of each following year to an amount twice that
1-31 of the previous calendar year."

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
