A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 39 of the Official Code of
1- 2 Georgia Annotated, relating to the regulation of the
1- 3 employment of minors, so as to delete certain provisions
1- 4 requiring the issuance of employment certificates as a
1- 5 condition of employment for minors; to provide that minors
1- 6 between the ages of 12 and 16 years shall have the written
1- 7 permission of parents or guardians before employment and
1- 8 shall submit proof of age; to provide for related matters;
1- 9 to repeal conflicting laws; and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-11 SECTION 1.
1-12 Chapter 2 of Title 39 of the Official Code of Georgia
1-13 Annotated, relating to the regulation of the employment of
1-14 minors, is amended by striking in its entirety Code Section
1-15 39-2-11, relating to requirements for the issuance of
1-16 employment certificates, and inserting in lieu thereof the
1-17 following:
1-18 "39-2-11.
1-19 (a) No minor between the ages of 12 and 16 years shall be
1-20 employed by or permitted to work for any person, firm, or
1-21 corporation unless a certificate, showing the true age of
1-22 such minor and that such minor is not less than 12 years
1-23 of age and is physically fit to engage in the employment
1-24 sought to be obtained, shall be issued by the school
1-25 superintendent or by some member of his staff authorized
1-26 by him in writing, in the county or city where the minor
1-27 resides or, if a student at a licensed private school, by
1-28 the principal administrative officer thereof or by some
1-29 member of his staff authorized by him in writing. A
1-30 certificate shall also be required for employment of
1-31 minors between the ages of 16 and 18.
1-32 (b) The certificate provided for in subsection (a) of this
1-33 Code section must show that the minor is 16 years of age
1-34 to qualify such minor to work between the hours of 9:00

2- 1 P.M. and 6:00 A.M. and to be employed in any of the
2- 2 occupations covered by Code Section 39-2-2.
2- 3 (c) No employment certificate shall be issued to any minor
2- 4 until he shall have submitted to the issuing officer:
2- 5 (1) A certified copy of a birth certificate or birth
2- 6 registration card; and
2- 7 (2) A statement from the prospective employer indicating
2- 8 that if he were furnished with a certificate from the
2- 9 school superintendent as required by law, he could
2-10 employ the minor immediately and describing the type of
2-11 employment offered. It shall be understood that the
2-12 prospective employer, by furnishing such statement, does
2-13 not undertake to employ the minor for any specific
2-14 period of time.
2-15 (d) A like certificate, a copy of which shall be made a
2-16 part of the minor's school file, shall be issued in cases
2-17 of all minors between the ages of 16 and 18. The
2-18 certificate must show that the minor is fully 16 years of
2-19 age in order to qualify the minor to work between the
2-20 hours of 9:00 P.M. and 6:00 A.M. and to be employed in any
2-21 of the occupations covered by Code Section 39-2-2. In
2-22 addition to the certificate, the superintendent of
2-23 schools, or some member of his staff authorized by him,
2-24 shall issue an identification card to each minor in this
2-25 category of employment. The identification card will
2-26 certify that the minor is eligible for employment. The
2-27 minor shall be exempt from future filings of employment
2-28 certificates unless his certificate is revoked by the
2-29 Commissioner of Labor. written permission for such
2-30 employment is given by the parents, guardian, or other
2-31 person having custody of such minor and evidence of the
2-32 minor's age is submitted to the employer in the form of a
2-33 certified copy of a birth certificate or birth
2-34 registration card."
2-35 SECTION 2.
2-36 Said chapter is further amended by striking and reserving in
2-37 their entirety Code Section 39-2-12, relating to the
2-38 contents of employment certificates, Code Section 39-2-13,
2-39 relating to the disposition of employment certificates upon
2-40 termination of employment, and Code Section 39-2-14,
2-41 relating to the revocation of employment certificates by the
2-42 Commissioner of Labor.

3- 2 All laws and parts of laws in conflict with this Act are
3- 3 repealed.
